AGRICULTURAL EDUCATION. 29 1. FARMERS WITH DISABILITIES PROGRAM. 9 1. The moneys appropriated in subsection 1 shall be used for 18 the public purpose of providing a grant to a national nonprofit 19 organization with over 80 years of experience in assisting 20 children and adults with disabilities and special needs. The 21 moneys shall be used to support a nationally recognized program 22 that began in 1986 and has been replicated in at least 30 other 23 states, but which is not available through any other entity 24 in this state, and that provides assistance to farmers with 25 disabilities in all 99 counties to allow the farmers to remain 26 in their own homes and be gainfully engaged in farming through 27 provision of agricultural worksite and home modification 28 consultations, peer support services, services to families, 29 information and referral, and equipment loan services. 30 3. Notwithstanding section 8.33 , moneys appropriated in 31 this section that remain unencumbered or unobligated at the 32 close of the fiscal year shall not revert but shall remain 33 available for expenditure for the purposes designated until the 34 close of the succeeding fiscal year. 35 -4- LSB 1001XC (7) 88 da/tm 4/ 25

WATER QUALITY INITIATIVE —— GENERAL. 14 1. There is appropriated from the general fund of the state 15 to the department of agriculture and land stewardship for the 16 fiscal year beginning July 1, 2019, and ending June 30, 2020, 17 the following amount, or so much thereof as is necessary, to be 18 used for the purposes designated: 19 For deposit in the water quality initiative fund created in 20 section 466B.45 , for purposes of supporting the water quality 21 initiative administered by the division of soil conservation 22 and water quality as provided in section 466B.42 , including 23 salaries, support, maintenance, and miscellaneous purposes: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 25 2. a. The moneys appropriated in subsection 1 shall be 26 used to support projects in subwatersheds as designated by the 27 division that are part of high-priority watersheds identified 28 by the water resources coordinating council established 29 pursuant to section 466B.3 . 30 b. The moneys appropriated in subsection 1 shall be used to 31 support projects in watersheds generally, including regional 32 watersheds, as designated by the division and high-priority 33 watersheds identified by the water resources coordinating 34 council established pursuant to section 466B.3. 35 -5- LSB 1001XC (7) 88 da/tm 5/ 25
S.F. _____ 3. In supporting projects in subwatersheds and watersheds 1 as provided in subsection 2, all of the following shall apply: 2 a. The demonstration projects shall utilize water quality 3 practices as described in the Iowa nutrient reduction strategy 4 as defined in section 455B.171 . 5 b. The division shall implement demonstration projects as 6 provided in paragraph “a” by providing for participation by 7 persons who hold a legal interest in agricultural land used in 8 farming. To every extent practical, the division shall provide 9 for collaborative participation by such persons who hold a 10 legal interest in agricultural land located within the same 11 subwatershed. 12 c. The division shall implement a demonstration project on 13 a cost-share basis as determined by the division. However, 14 except for edge-of-field practices, the state’s share of the 15 amount shall not exceed 50 percent of the estimated cost of 16 establishing the practice as determined by the division or 17 50 percent of the actual cost of establishing the practice, 18 whichever is less. 19 d. The demonstration projects shall be used to educate other 20 persons about the feasibility and value of establishing similar 21 water quality practices. The division shall promote field day 22 events for purposes of allowing interested persons to establish 23 water quality practices on their agricultural land. 24 e. The division shall conduct water quality evaluations 25 within supported subwatersheds. Within a reasonable period 26 after accumulating information from such evaluations, the 27 division shall create an aggregated database of water quality 28 practices. Any information identifying a person holding a 29 legal interest in agricultural land or specific agricultural 30 land shall be a confidential record under section 22.7 . 31 4. The moneys appropriated in subsection 1 shall be used 32 to support education and outreach in a manner that encourages 33 persons who hold a legal interest in agricultural land used for 34 farming to implement water quality practices, including the 35 -6- LSB 1001XC (7) 88 da/tm 6/ 25
S.F. _____ establishment of such practices in watersheds generally, and 1 not limited to subwatersheds or high-priority watersheds. 2 5. The moneys appropriated in subsection 1 may be used 3 to contract with persons to coordinate the implementation of 4 efforts provided in this section. 5 6. The moneys appropriated in subsection 1 may be used by 6 the department to support urban soil and water conservation 7 efforts, which may include but are not limited to management 8 practices related to bioretention, landscaping, the use of 9 permeable or pervious pavement, and soil quality restoration. 10 The moneys shall be allocated on a cost-share basis as provided 11 in chapter 161A. 12 7. Notwithstanding any other provision of law to the 13 contrary, the department may use moneys appropriated in 14 subsection 1 to carry out the provisions of this section on a 15 cost-share basis in combination with other moneys available to 16 the department from a state or federal source. 17 8. Not more than 10 percent of the moneys appropriated in 18 this section may be used to pay for the costs of administering 19 and implementing the water quality initiative by the 20 department’s division of soil conservation and water quality as 21 provided in section 466B.42 and this section. 22 DIVISION III 23 DEPARTMENT OF NATURAL RESOURCES 24 Sec. 10. GENERAL FUND —— DEPARTMENT. 25 1. The department shall submit a report each quarter of the 9 fiscal year to the legislative services agency, the department 10 of management, the members of the joint appropriations 11 subcommittee on agriculture and natural resources, and the 12 chairpersons and ranking members of the senate and house 13 committees on appropriations. The report shall describe in 14 detail the expenditure of moneys appropriated under this 15 section to support the department’s administration, regulation, 16 and programs. 17 Sec. 11. STATE FISH AND GAME PROTECTION FUND —— REGULATION 18 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 19 1. There is appropriated from the state fish and game 20 protection fund created pursuant to section 456A.17 to the 21 department of natural resources for the fiscal year beginning 22 July 1, 2019, and ending June 30, 2020, the following amount, 23 or so much thereof as is necessary, to be used for the purposes 24 designated: 25 For purposes of supporting the regulation or advancement of 26 hunting, fishing, or trapping, or the protection, propagation, 27 restoration, management, or harvest of fish or wildlife, 28 including for administration, regulation, law enforcement, and 29 programs; and for salaries, support, maintenance, equipment, 30 and miscellaneous purposes: 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 44,007,044 32 2. The moneys appropriated in subsection 1 shall be used to 9 support projects in watersheds generally, including regional 10 watersheds, as designated by the division and high-priority 11 watersheds identified by the water resources coordinating 12 council established pursuant to section 466B.3. 13 3. In supporting projects in subwatersheds and watersheds 14 as provided in subsection 2, all of the following shall apply: 15 a. The demonstration projects shall utilize water quality 16 practices as described in the Iowa nutrient reduction strategy 17 as defined in section 455B.171 . 18 b. The division shall implement demonstration projects as 19 provided in paragraph “a” by providing for participation by 20 persons who hold a legal interest in agricultural land used in 21 farming. To every extent practical, the division shall provide 22 for collaborative participation by such persons who hold a 23 legal interest in agricultural land located within the same 24 subwatershed. 25 c. The division shall implement a demonstration project on 26 a cost-share basis as determined by the division. However, 27 except for edge-of-field practices, the state’s share of the 28 amount shall not exceed 50 percent of the estimated cost of 29 establishing the practice as determined by the division or 30 50 percent of the actual cost of establishing the practice, 31 whichever is less. 32 d. The demonstration projects shall be used to educate other 33 persons about the feasibility and value of establishing similar 34 water quality practices. The division shall promote field day 35 -18- LSB 1001XC (7) 88 da/tm 18/ 25
S.F. _____ events for purposes of allowing interested persons to establish 1 water quality practices on their agricultural land. 2 e. The division shall conduct water quality evaluations 3 within supported subwatersheds. Within a reasonable period 4 after accumulating information from such evaluations, the 5 division shall create an aggregated database of water quality 6 practices. Any information identifying a person holding a 7 legal interest in agricultural land or specific agricultural 8 land shall be a confidential record under section 22.7 . 9 4. The moneys appropriated in subsection 1 shall be used 10 to support education and outreach in a manner that encourages 11 persons who hold a legal interest in agricultural land used for 12 farming to implement water quality practices, including the 13 establishment of such practices in watersheds generally, and 14 not limited to subwatersheds or high-priority watersheds. 15 5. The moneys appropriated in subsection 1 may be used 16 to contract with persons to coordinate the implementation of 17 efforts provided in this section. 18 6. The moneys appropriated in subsection 1 may be used by 19 the department to support urban soil and water conservation 20 efforts, which may include but are not limited to management 21 practices related to bioretention, landscaping, the use of 22 permeable or pervious pavement, and soil quality restoration. 23 The moneys shall be allocated on a cost-share basis as provided 24 in chapter 161A. 25 7. Notwithstanding any other provision of law to the 26 contrary, the department may use moneys appropriated in 27 subsection 1 to carry out the provisions of this section on a 28 cost-share basis in combination with other moneys available to 29 the department from a state or federal source. 30 8. Not more than 10 percent of the moneys appropriated in 31 this section may be used to pay for the costs of administering 32 and implementing the water quality initiative by the 33 department’s division of soil conservation and water quality as 34 provided in section 466B.42 and this section. 35 -19- LSB 1001XC (7) 88 da/tm 19/ 25

Section 456.10, Code 2019, is amended to read as 2 follows: 3 456.10 Distribution of reports. 4 All publications of the Iowa geological survey shall be made 5 available electronically via an internet site maintained for 6 that purpose. 7 Sec. 28. Section 456.13, Code 2019, is amended to read as 8 follows: 9 456.13 Maps property of state —— custody —— copies. 10 The maps so delivered to the state geologist shall be the 11 property of the state and shall remain in the custody of the 12 state geologist. They shall be kept at the office of the Iowa 13 geological survey and be open to examination by all persons 14 interested in the maps; but such examination shall only be made 15 in the presence of the state geologist or a designee, and the 16 state geologist shall not permit any copies of the maps to be 17 made without the written consent of the operator or the owner 18 of the property, except as provided in section 456.11 or if the 19 mine has been abandoned for at least five years. 20 DIVISION IX 21 WAREHOUSE OPERATORS —— LIEN 22 Sec. 29. Section 554.7209, Code 2019, is amended by adding 23 the following new subsection: 24 NEW SUBSECTION . 3A. Notwithstanding any provision in 25 this section to the contrary, a warehouse’s lien created in 26 subsection 1, that is in favor of a warehouse operator licensed 27 under either chapter 203C or the United States Warehouse Act, 7 28 U.S.C. ch. 10, is effective against all persons and is superior 29 against all other competing security interests and agricultural 30 liens. 31 Sec. 30. EFFECTIVE DATE. This bill relates to agriculture and natural 2 resources by making appropriations for the fiscal year 3 2019-2020 to support related entities, including the department 4 of agriculture and land stewardship (DALS), the department of 5 natural resources (DNR), and Iowa state university (ISU), and 6 the university of Iowa (UI). 7 The bill primarily appropriates moneys to DALS and DNR. 8 The appropriations are made to support those departments for 9 administration, regulation, and support of programs. The bill 10 requires the departments to submit quarterly reports to the 11 general assembly and department of management regarding the 12 expenditure of appropriated moneys. The bill also provides 13 moneys to support specific programs or projects administered 14 by those departments. The bill appropriates moneys from a 15 number of sources, including the general fund of the state 16 (general fund), the state fish and game protection fund, the 17 groundwater protection fund, and the environment first fund 18 (EFF). Appropriations are made from a number of sources to 19 support the water quality initiative (WQI). The bill is 20 organized into divisions. 21 DALS —— GENERAL FUND APPROPRIATIONS. The bill appropriates 22 moneys to DALS from the general fund in order to support its 23 administrative divisions, including consumer protection and 24 industry services, soil conservation, and food safety and 25 animal health. Moneys are transferred to ISU to support its 26 midwest grape and wine institute. Moneys are also transferred 27 to ISU to support the college of veterinary medicine for the 28 operation of the veterinary diagnostic laboratory, contingent 29 upon the enactment of 2019 Iowa Acts, senate file 601. 30 DALS —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 31 The bill appropriates moneys from several sources to support a 32 number of designated purposes, including moneys derived from 33 unclaimed winnings from horse and dog races, for administration 34 and enforcement of racing regulations; and moneys credited 35 -22- LSB 1001XC (7) 88 da/tm 22/ 25
S.F. _____ to the renewable fuel infrastructure fund, for purposes of 1 regulating motor fuel. 2 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill also 3 makes special appropriations from the general fund to DALS in 4 order to support specific purposes including milk inspection, 5 the local food and farm program, an agricultural education 6 organization, assistance to farmers with disabilities, and for 7 foreign animal disease preparedness. 8 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY. The 9 bill appropriates moneys from the general fund to DALS for 10 deposit in the water quality initiative fund, to support the 11 WQI including high-priority watershed projects. The bill 12 appropriates moneys from the general fund to DALS for deposit 13 in the agricultural drainage well water quality assistance fund 14 for purposes of supporting the agricultural drainage well water 15 quality assistance program. 16 DNR —— GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS. 17 The bill makes appropriations from a number of funds to DNR in 18 order to support its administrative divisions involving natural 19 resources and environmental protection from the general fund, 20 the state fish and game protection fund, and the groundwater 21 protection fund. 22 DNR —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS. 23 The bill appropriates moneys to DNR from a number of sources 24 to support designated purposes, including moneys deposited in 25 the special snowmobile fund to provide for administering and 26 enforcing the state snowmobile programs; and moneys deposited 27 in the unassigned revenue fund for purposes of paying for 28 administration of DNR’s underground storage tanks section. 29 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill also 30 makes special appropriations from the general fund to DNR 31 in order to support specific purposes including floodplain 32 management and dam safety and forestry health management 33 programs. 34 ISU —— SPECIAL GENERAL FUND APPROPRIATIONS. S.F. _____ appropriates moneys from the general fund to ISU to support the 1 operation of its veterinary diagnostic laboratory. 2 DALS, DNR, AND UI —— EFF —— GENERAL APPROPRIATIONS. The 3 bill appropriates moneys from the EFF to support a number of 4 programs administered by DALS, DNR, and UI. For DALS, the 5 moneys are appropriated to support programs involving soil 6 conservation, watershed protection and nutrient management, 7 and the loess hills development and conservation fund. For 8 DNR, moneys are appropriated to support programs involving 9 state parks, geographic information systems, water quality 10 monitoring, public water supplies, regulation of animal feeding 11 operations, air quality, and floodplain management and dam 12 safety. For UI, moneys are appropriated to support the Iowa 13 geological survey. The bill includes provisions that delay the 14 reversion of these moneys. 15 EFF —— SPECIAL APPROPRIATIONS FOR WQI. The bill 16 appropriates moneys from the EFF to the water quality 17 initiative fund subject to the same conditions applicable to 18 moneys appropriated to the fund from the general fund. 19 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND —— EFF 20 APPROPRIATION IN LIEU OF GENERAL FUND APPROPRIATION. An amount 21 of moneys is appropriated from the EFF to the REAP fund instead 22 of the $20,0000 otherwise required to be appropriated to the 23 fund from the general fund. 24 RELATED CODE CHANGES —— IOWA GEOLOGICAL SURVEY. The name 25 of the geological survey of the state is changed to the Iowa 26 geological survey to comply with current naming conventions. 27 RELATED CODE CHANGES —— PROGRAMS TO AUDIT MOTOR FUEL. The 28 provisions in the bill that authorize DALS to establish and 29 administer programs for auditing motor fuel production and 30 processing, motor fuel screening and testing, and inspection of 31 motor fuel sold by dealers is codified. The provision has been 32 included in previous appropriation bills since 2006. 33 RELATED CODE CHANGES —— WAREHOUSE OPERATORS LIEN.
