S.F. _____ Section 1. NEW SECTION . 914.8 Discharge of sentence —— 1 defined. 2 A person shall not be considered to have discharged a 3 sentence for purposes of Article II, section 5, of the 4 Constitution of the State of Iowa unless the person has paid 5 all restitution, court costs, fines, surcharges, or penalties 6 the person owes as a result of the person’s conviction and has 7 been removed from the sex offender registry established in 8 chapter 692A. 9 Sec. 2. CONTINGENT EFFECTIVE DATE. This Act takes effect 10 upon the ratification of the constitutional amendment contained 11 in House Study Bill 68 or Senate Study Bill 1046 of the 12 eighty-eighth general assembly pursuant to Article X, section 13 1, of the Constitution of the State of Iowa. 14 Sec. 3. CONTINGENT REPEAL. This Act is repealed if the 15 constitutional amendment contained in House Study Bill 68 or 16 Senate Study Bill 1046 of the eighty-eighth general assembly 17 is not ratified pursuant to Article X, section 1, of the 18 Constitution of the State of Iowa prior to January 1, 2023. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill relates to the definition of a discharge of a 23 criminal sentence for the purposes of the automatic restoration 24 of a convicted person’s voting rights pursuant to the 25 constitutional amendment contained in House Study Bill 68 and 26 Senate Study Bill 1046 of the 88th general assembly. If the 27 constitutional amendment contained in either bill is ratified 28 by the electors pursuant to Article X, section 1, of the Iowa 29 Constitution, the bill becomes effective and defines the 30 discharge of a criminal sentence as including the payment of 31 all restitution, court costs, fines, surcharges, or penalties 32 the person owes as a result of the person’s conviction and 33 removal from the sex offender registry established in Code 34 chapter 692A.
