There is appropriated from the general fund of the state 5 to the department of justice for the fiscal year beginning July 6 1, 2019, and ending June 30, 2020, the following amounts, or 7 so much thereof as is necessary, to be used for the purposes 8 designated: 9 a. For the general office of attorney general for salaries, 10 support, maintenance, and miscellaneous purposes, including 11 the prosecuting attorneys training program, matching funds 12 for federal violence against women grant programs, victim 13 assistance grants, office of drug control policy prosecuting 14 attorney program, and odometer fraud enforcement: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,911,705 16 As a condition of receiving the appropriation provided 17 in this lettered paragraph, the department of justice shall 18 maintain a record of the estimated time incurred representing 19 each agency or department. 20 b. For victim assistance grants: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,016,708 22 The moneys appropriated in this lettered paragraph shall be 23 used to provide grants to care providers providing services to 24 crime victims of domestic abuse or to crime victims of rape and 25 sexual assault. 26 The balance of the victim compensation fund established 27 in section 915.94 may be used to provide salary and support 28 of not more than 24.00 full-time equivalent positions and to 29 provide maintenance for the victim compensation functions 30 of the department of justice. In addition to the full-time 31 equivalent positions authorized pursuant to this paragraph, 32 5.00 full-time equivalent positions are authorized and shall 33 be used by the department of justice to employ one accountant 34 and four program planners. S.F. _____ H.F. _____ employ the additional 5.00 full-time equivalent positions 1 authorized pursuant to this paragraph that are in excess of the 2 number of full-time equivalent positions authorized only if 3 the department of justice receives sufficient federal moneys 4 to maintain employment for the additional full-time equivalent 5 positions during the fiscal year beginning July 1, 2019. The 6 department of justice shall only employ the additional 5.00 7 full-time equivalent positions in succeeding fiscal years if 8 sufficient federal moneys are received during each of those 9 succeeding fiscal years. 10 The department of justice shall transfer at least $150,000 11 from the victim compensation fund established in section 915.94 12 to the victim assistance grant program. 13 Notwithstanding section 8.33, moneys appropriated in this 14 paragraph “b” that remain unencumbered or unobligated at the 15 close of the fiscal year shall not revert but shall remain 16 available for expenditure for the purposes designated until the 17 close of the succeeding fiscal year. 18 c. The general office of attorney general may temporarily 22 exceed and draw more than the amount appropriated in this 23 subsection and incur a negative cash balance as long as there 24 are receivables equal to or greater than the negative balance 25 and the amount appropriated in this subsection is not exceeded 26 at the close of the fiscal year. 27 2. a. The department of justice, in submitting budget 28 estimates for the fiscal year commencing July 1, 2020, pursuant 29 to section 8.23, shall include a report of funding from sources 30 other than amounts appropriated directly from the general fund 31 of the state to the department of justice or to the office of 32 consumer advocate. These funding sources shall include but 33 are not limited to reimbursements from other state agencies, 34 commissions, boards, or similar entities, and reimbursements 35 -2- LSB 1014XG (10) 88 asf/tm 2/ 41

The department of justice shall also report actual 2 reimbursements for the fiscal year commencing July 1, 2019, 3 and actual and expected reimbursements for the fiscal year 4 commencing July 1, 2020. 5 b. The department of justice shall include the report 6 required under paragraph “a”, as well as information regarding 7 any revisions occurring as a result of reimbursements actually 8 received or expected at a later date, in a report to the 9 co-chairpersons and ranking members of the joint appropriations 10 subcommittee on the justice system and the legislative services 11 agency. The department of justice shall submit the report on 12 or before January 15, 2021. 13 3. a. The department of justice shall fully reimburse 14 the costs and necessary related expenses incurred by the Iowa 15 law enforcement academy to continue to employ one additional 16 instructor position who shall provide training for human 17 trafficking-related issues throughout the state. 18 b. The department of justice shall obtain the moneys 19 necessary to reimburse the Iowa law enforcement academy to 20 employ such an instructor from unrestricted moneys from either 21 the victim compensation fund established in section 915.94, the 22 human trafficking victim fund established in section 915.95, or 23 the human trafficking enforcement fund established in 2015 Iowa 24 Acts, chapter 138, section 141. 25 Sec. 2. OFFICE OF CONSUMER ADVOCATE. It is the intent of the general assembly that each 1 lease negotiated by the department of corrections with a 2 private corporation for the purpose of providing private 3 industry employment of inmates in a correctional institution 4 shall prohibit the private corporation from utilizing inmate 5 labor for partisan political purposes for any person seeking 6 election to public office in this state and that a violation 7 of this requirement shall result in a termination of the lease 8 agreement. 9 b. It is the intent of the general assembly that as a 10 condition of receiving the appropriation provided in this 11 subsection the department of corrections shall not enter into 12 a lease or contractual agreement pursuant to section 904.809 13 with a private corporation for the use of building space for 14 the purpose of providing inmate employment without providing 15 that the terms of the lease or contract establish safeguards to 16 restrict, to the greatest extent feasible, access by inmates 17 working for the private corporation to personal identifying 18 information of citizens. 19 2. The director of the department of corrections may 28 transfer moneys from Iowa prison industries and the canteen 29 operating funds established pursuant to section 904.310, for 30 use in educational programs for inmates. 31 c. Each judicial district department of correctional 21 services, within the funding available, shall continue programs 22 and plans established within that district to provide for 23 intensive supervision, sex offender treatment, diversion of 24 low-risk offenders to the least restrictive sanction available, 25 job development, and expanded use of intermediate criminal 26 sanctions. 27 3. Each judicial district department of correctional 28 services shall provide alternatives to prison consistent with 29 chapter 901B. The alternatives to prison shall ensure public 30 safety while providing maximum rehabilitation to the offender. 31 A judicial district department of correctional services may 32 also establish a day program. 33 4. The governor’s office of drug control policy shall 34 consider federal grants made to the department of corrections 35 -8- LSB 1014XG (10) 88 asf/tm 8/ 41
S.F. _____ H.F. _____ for the benefit of each of the eight judicial district 1 departments of correctional services as local government 2 grants, as defined pursuant to federal regulations. 3 5. The department of corrections shall continue to contract 4 with a judicial district department of correctional services to 5 provide for the rental of electronic monitoring equipment which 6 shall be available statewide. 7 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 8 APPROPRIATIONS. Notwithstanding section 8.39, within the 9 moneys appropriated in this division of this Act to the 10 department of corrections, the department may reallocate the 11 moneys appropriated and allocated as necessary to best fulfill 12 the needs of the correctional institutions, administration 13 of the department, and the judicial district departments of 14 correctional services. However, in addition to complying with 15 the requirements of sections 904.116 and 905.8 and providing 16 notice to the legislative services agency, the department 17 of corrections shall also provide notice to the department 18 of management, prior to the effective date of the revision 19 or reallocation of an appropriation made pursuant to this 20 section. The department of corrections shall not reallocate an 21 appropriation or allocation for the purpose of eliminating any 22 program. 23 Sec. 7. INTENT —— REPORTS. 24 1. The department of corrections in cooperation with 25 townships, the Iowa cemetery associations, and other nonprofit 26 or governmental entities may use inmate labor during the 27 fiscal year beginning July 1, 2019, to restore or preserve 28 rural cemeteries and historical landmarks. The department in 29 cooperation with the counties may also use inmate labor to 30 clean up roads, major water sources, and other water sources 31 around the state. 32 2. On a quarterly basis the department shall provide a 33 status report regarding private-sector employment to the 34 legislative services agency beginning on July 1, 2019. S.F. _____ H.F. _____ report shall include the number of offenders employed in the 1 private sector, the combined number of hours worked by the 2 offenders, the total amount of allowances, and the distribution 3 of allowances pursuant to section 904.702, including any moneys 4 deposited in the general fund of the state. 5 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 6 corrections shall submit a report on electronic monitoring to 7 the general assembly, to the co-chairpersons and the ranking 8 members of the joint appropriations subcommittee on the justice 9 system, and to the legislative services agency by January 10 15, 2020. The report shall specifically address the number 11 of persons being electronically monitored and break down the 12 number of persons being electronically monitored by offense 13 committed. The report shall also include a comparison of any 14 data from the prior fiscal year with the current year. 15 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 16 1. As used in this section, unless the context otherwise 17 requires, “state agency” means the government of the state 18 of Iowa, including but not limited to all executive branch 19 departments, agencies, boards, bureaus, and commissions, the 20 judicial branch, the general assembly and all legislative 21 agencies, institutions within the purview of the state board of 22 regents, and any corporation whose primary function is to act 23 as an instrumentality of the state. 24 2. State agencies are encouraged to purchase products from 25 Iowa state industries, as defined in section 904.802, when 26 purchases are required and the products are available from 27 Iowa state industries. State agencies shall obtain bids from 28 Iowa state industries for purchases of office furniture during 29 the fiscal year beginning July 1, 2019, exceeding $5,000 or 30 in accordance with applicable administrative rules related to 31 purchases for the agency. 32 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 33 1. There is appropriated from the general fund of the 34 state to the Iowa law enforcement academy for the fiscal year 35 -10- LSB 1014XG (10) 88 asf/tm 10/ 41

The Iowa law enforcement academy may select at least 17 five automobiles of the department of public safety, division 18 of state patrol, prior to turning over the automobiles to 19 the department of administrative services to be disposed 20 of by public auction, and the Iowa law enforcement academy 21 may exchange any automobile owned by the academy for each 22 automobile selected if the selected automobile is used in 23 training law enforcement officers at the academy. However, any 24 automobile exchanged by the academy shall be substituted for 25 the selected vehicle of the department of public safety and 26 sold by public auction with the receipts being deposited in the 27 depreciation fund to the credit of the department of public 28 safety, division of state patrol. 29 3. The Iowa law enforcement academy shall provide training 30 for domestic abuse and human trafficking-related issues 31 throughout the state. The training shall be offered at no 32 cost to the attendees and the training shall not replace any 33 existing domestic abuse or human trafficking training offered 34 by the academy. 35 -11- LSB 1014XG (10) 88 asf/tm 11/ 41

Each judicial district department of correctional 10 services shall provide alternatives to prison consistent with 11 chapter 901B. The alternatives to prison shall ensure public 12 safety while providing maximum rehabilitation to the offender. 13 A judicial district department of correctional services may 14 also establish a day program. 15 4. The governor’s office of drug control policy shall 16 consider federal grants made to the department of corrections 17 for the benefit of each of the eight judicial district 18 departments of correctional services as local government 19 grants, as defined pursuant to federal regulations. 20 5. The department of corrections shall continue to contract 21 with a judicial district department of correctional services to 22 provide for the rental of electronic monitoring equipment which 23 shall be available statewide. 24 Sec. 26. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 25 APPROPRIATIONS. Notwithstanding section 8.39, within the 26 moneys appropriated in this division of this Act to the 27 department of corrections, the department may reallocate the 28 moneys appropriated and allocated as necessary to best fulfill 29 the needs of the correctional institutions, administration 30 of the department, and the judicial district departments of 31 correctional services. However, in addition to complying with 32 the requirements of sections 904.116 and 905.8 and providing 33 notice to the legislative services agency, the department 34 of corrections shall also provide notice to the department 35 -27- LSB 1014XG (10) 88 asf/tm 27/ 41
S.F. _____ H.F. _____ of management, prior to the effective date of the revision 1 or reallocation of an appropriation made pursuant to this 2 section. The department of corrections shall not reallocate an 3 appropriation or allocation for the purpose of eliminating any 4 program. 5 Sec. 27. INTENT —— REPORTS. 6 1. The department of corrections in cooperation with 7 townships, the Iowa cemetery associations, and other nonprofit 8 or governmental entities may use inmate labor during the 9 fiscal year beginning July 1, 2020, to restore or preserve 10 rural cemeteries and historical landmarks. The department in 11 cooperation with the counties may also use inmate labor to 12 clean up roads, major water sources, and other water sources 13 around the state. 14 2. On a quarterly basis the department shall provide a 15 status report regarding private-sector employment to the 16 legislative services agency beginning on July 1, 2020. The 17 report shall include the number of offenders employed in the 18 private sector, the combined number of hours worked by the 19 offenders, the total amount of allowances, and the distribution 20 of allowances pursuant to section 904.702, including any moneys 21 deposited in the general fund of the state. 22 Sec. 28. ELECTRONIC MONITORING REPORT. The department of 23 corrections shall submit a report on electronic monitoring to 24 the general assembly, to the co-chairpersons and the ranking 25 members of the joint appropriations subcommittee on the justice 26 system, and to the legislative services agency by January 27 15, 2021. The report shall specifically address the number 28 of persons being electronically monitored and break down the 29 number of persons being electronically monitored by offense 30 committed. The report shall also include a comparison of any 31 data from the prior fiscal year with the current year. 32 Sec. 29. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 33 1. As used in this section, unless the context otherwise 34 requires, “state agency” means the government of the state 35 -28- LSB 1014XG (10) 88 asf/tm 28/ 41
S.F. _____ H.F. _____ of Iowa, including but not limited to all executive branch 1 departments, agencies, boards, bureaus, and commissions, the 2 judicial branch, the general assembly and all legislative 3 agencies, institutions within the purview of the state board of 4 regents, and any corporation whose primary function is to act 5 as an instrumentality of the state. 6 2. State agencies are encouraged to purchase products from 7 Iowa state industries, as defined in section 904.802, when 8 purchases are required and the products are available from 9 Iowa state industries. State agencies shall obtain bids from 10 Iowa state industries for purchases of office furniture during 11 the fiscal year beginning July 1, 2020, exceeding $5,000 or 12 in accordance with applicable administrative rules related to 13 purchases for the agency. 14 Sec. 30. IOWA LAW ENFORCEMENT ACADEMY. 15 1. There is appropriated from the general fund of the 16 state to the Iowa law enforcement academy for the fiscal year 17 beginning July 1, 2020, and ending June 30, 2021, the following 18 amount, or so much thereof as is necessary, to be used for the 19 purposes designated: 20 a. EFFECTIVE DATE. This division of this Act, being 18 deemed of immediate importance, takes effect upon enactment. 19 DIVISION IV 20 FIRE SERVICE TRAINING REVOLVING FUND 21 Sec. 44. Section 100B.4, Code 2019, is amended to read as 22 follows: 23 100B.4 Fees —— retention —— use —— fund . 24 1. Fees assessed pursuant to this chapter shall be retained 25 by the division of state fire marshal and such repayments 26 received shall be used exclusively to offset the cost of 27 fire service training. Fees charged by regional emergency 28 response training centers for fire service training programs as 29 described in section 100B.6 shall not be greater than the fee 30 schedule established by rule by the state fire marshal. 31 2. Notwithstanding section 8.33 , repayment receipts 32 collected by the division of state fire marshal for the fire 33 service training bureau that remain unencumbered or unobligated 34 at the close of the fiscal year shall not revert but shall 35 -38- LSB 1014XG (10) 88 asf/tm 38/ 41

A fire service training revolving fund is created in the 3 state treasury under the control of the department of public 4 safety. The fund shall consist of fees assessed pursuant to 5 this section, and deposited into the fire service training 6 revolving fund. All moneys in the fund are appropriated to 7 the department of public safety for purposes of fire service 8 training and shall be under the control of the state fire 9 marshal. Notwithstanding section 8.33, moneys in the fund 10 that remain unencumbered or unobligated at the close of a 11 fiscal year shall not revert but shall remain available for 12 expenditures for the purposes designated until the close of 13 the succeeding fiscal year. Notwithstanding section 12C.7, 14 subsection 2, interest or earnings on moneys in the fund shall 15 be credited to the fund. 16 Sec. 45. EFFECTIVE DATE. This division of this Act, being 17 deemed of immediate importance, takes effect upon enactment. 18 Sec. 46. RETROACTIVE APPLICABILITY. This division of this 19 Act applies retroactively to July 1, 2018. 20 DIVISION V 21 DEPARTMENT OF CORRECTIONS 22 Sec. 47. DEPARTMENT OF CORRECTIONS. Notwithstanding 23 sections 8.33 and 8.39, the department of corrections may use 24 any general fund resources appropriated to the department 25 for the fiscal year beginning July 1, 2018, and ending June 26 30, 2019, for the resolution of the settlement agreement 27 with the division of labor services to the amended citation 28 P1582-1281728 dated October 18, 2018; requiring the department 29 to remedy citation 1(a) by providing adequate means of 30 communication for employees to summon assistance during violent 31 attacks, which must be abated by March 1, 2019. 32 Sec. 48. The bill is organized by divisions. 4 FY 2019-2020 APPROPRIATIONS. The bill makes appropriations 5 from the general fund of the state for fiscal year 2019-2020 to 6 the departments of justice, corrections, public defense, public 7 safety, and homeland security and emergency management, and 8 the Iowa law enforcement academy, office of the state public 9 defender, board of parole, Iowa state civil rights commission, 10 and the criminal and juvenile justice planning division of the 11 department of human rights. 12 The bill appropriates moneys from the consumer education and 13 litigation fund to the department of justice for farm mediation 14 services for fiscal year 2019-2020. 15 The bill appropriates moneys from the department of commerce 16 revolving fund to the office of consumer advocate of the 17 department of justice for fiscal year 2019-2020. 18 The bill also appropriates moneys from the gaming 19 enforcement revolving fund to the department of public safety 20 for fiscal year 2019-2020. 21 The bill appropriates moneys from the wireless E911 22 emergency communications fund to the department of homeland 23 security and emergency management for fiscal year 2019-2020. 24 The bill provides that moneys appropriated to the veterans 25 trust fund established in Code section 35A.13 may be used, upon 26 a majority vote of the commission of veterans affairs, for 27 expenses related to survivor outreach supported by the Iowa 28 department of public defense. 29 FY 2020-2021 APPROPRIATIONS. The bill makes appropriations 30 from the general fund of the state for fiscal year 2020-2021 to 31 the departments of justice, corrections, public defense, public 32 safety, and homeland security and emergency management, and 33 the Iowa law enforcement academy, office of the state public 34 defender, board of parole, Iowa state civil rights commission, 35 -40- LSB 1014XG (10) 88 asf/tm 40/ 41

The bill 18 appropriates moneys to the state public defender and the Iowa 19 law enforcement academy for the fiscal year 2018-2019.
