by
adding
the
following
new
paragraph:

.
c.
Rules
shall
not
be
adopted
that
require

an
owner
of
a
peat
moss
biofilter
system,
a
recirculating

textile
filter
system,
or
an
aerobic
treatment
unit
to
enter
5
into
a
maintenance
contract.
However,
a
person
who
owns
a
peat
6
moss
biofilter
system,
a
recirculating
textile
filter
system,
7
or
an
aerobic
treatment
unit
shall
have
their
system
inspected
8
and,
if
necessary,
have
maintenance
performed
by
a
technician
9
at
least
once
every
three
years.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
rules
related
to
the
maintenance
of
14
septic
systems.
15
Current
law
requires
the
environmental
protection
commission
16
to
establish
rules
relating
to
the
maintenance
of
disposal
17
systems.
The
bill
prohibits
the
commission
from
adopting
18
rules
that
require
an
owner
of
a
peat
moss
biofilter
system,
a
19
recirculating
textile
filter
system,
or
an
aerobic
treatment
20
unit
to
enter
into
a
maintenance
contract.
However,
the
21
bill
requires
an
owner
of
a
peat
moss
biofilter
system,
a
22
recirculating
textile
filter
system,
or
an
aerobic
treatment
23
unit
to
have
the
system
inspected
and,
if
necessary,
have
24
maintenance
performed
by
a
technician
at
least
once
every
three
25
years.
