Section
321.234,
Code
2019,
is
amended
by
adding

the
following
new
subsection:

person
riding
a
bicycle
on
the

highway,
when
being
overtaken
and
passed
by
a
farm
tractor
or

self-propelled
implement
of
husbandry,
shall
give
way
to
the

right
in
favor
of
the
overtaking
farm
tractor
or
self-propelled

implement
of
husbandry
and
shall
not
increase
the
speed
of
the
7
bicycle
until
completely
passed
by
the
overtaking
farm
tractor
8
or
self-propelled
implement
of
husbandry.

Under
current
law,
Code
section
321.234
provides
that
a
17
person
riding
a
bicycle
on
the
highway
is
subject
to
the
18
provisions
of
Code
chapter
321
and
has
all
the
rights
and
19
duties
applicable
to
the
driver
of
a
vehicle.
Code
section
20
321.299
requires
the
driver
of
an
overtaken
vehicle
to
give
way
21
to
the
right
in
favor
of
the
overtaking
vehicle
and
prohibits
22
the
driver
from
increasing
the
speed
of
the
overtaken
vehicle
23
until
completely
passed
by
the
overtaking
vehicle,
except
when
24
overtaking
and
passing
on
the
right
is
permitted.
25
This
bill
specifies
that
a
person
riding
a
bicycle
on
the
26
highway,
when
being
overtaken
and
passed
by
a
farm
tractor
or
27
self-propelled
implement
of
husbandry,
must
give
way
to
the
28
right
in
favor
of
the
overtaking
farm
tractor
or
self-propelled
29
implement
of
husbandry
and
is
prohibited
from
increasing
the
30
speed
of
the
bicycle
until
completely
passed
by
the
overtaking
31
farm
tractor
or
self-propelled
implement
of
husbandry.
A
32
violation
of
the
bill
is
punishable
by
a
scheduled
fine
of
$25.

By
operation
of
law,
the
bill
does
not
apply
to
the
use
of
a
34
bicycle
in
a
parade
authorized
by
a
proper
permit
from
local

Under
Code
section
321.1,
a
“farm
tractor”
is
a
motor
2
vehicle
designed
and
used
primarily
as
a
farm
implement
3
for
drawing
plows,
mowing
machines,
and
other
implements
of
4
husbandry.
An
“implement
of
husbandry”
is
a
vehicle
or
special
5
mobile
equipment
manufactured,
designed,
or
reconstructed
6
for
agricultural
purposes
and,
except
for
incidental
uses,
7
exclusively
used
in
the
conduct
of
agricultural
operations.
8
“Implement
of
husbandry”
includes
certain
all-terrain
vehicles,
9
fence-line
feeders,
and
vehicles
used
exclusively
for
the
10
application
of
organic
or
inorganic
plant
food
materials,
11
organic
agricultural
limestone,
or
agricultural
chemicals.
12
To
be
considered
an
implement
of
husbandry,
a
self-propelled
13
implement
of
husbandry
must
be
operated
at
a
speed
of
35
miles
14
per
hour
or
less.
