S.F. 2417 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 9 a. (1) For deposit in the water quality initiative fund 10 created in section 466B.45 for purposes of supporting the 11 water quality initiative administered by the division of soil 12 conservation and water quality as provided in section 466B.42, 13 including salaries, support, maintenance, and miscellaneous 14 purposes, notwithstanding section 8.57, subsection 5, paragraph 15 “c”: 16 FY 2020-2021: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 18 (2) (a) The moneys appropriated in this lettered 19 paragraph shall be used to support demonstration projects in 20 subwatersheds as designated by the department that are part 21 of high-priority watersheds identified by the water resources 22 coordinating council. 23 (b) The moneys appropriated in this lettered paragraph 24 shall be used to support demonstration projects in watersheds 25 generally, including regional watersheds, as designated by the 26 division and high-priority watersheds identified by the water 27 resources coordinating council. 28 (3) In supporting projects in watersheds and subwatersheds 29 as provided in subparagraph (2), subparagraph divisions (a) and 30 (b), all of the following shall apply: 31 (a) The demonstration projects shall utilize water quality 32 practices as described in the latest revision of the document 33 entitled “Iowa Nutrient Reduction Strategy” initially presented 34 in November 2012 by the department of agriculture and land 35 -1- LSB 5008SV (2) 88 ec/tm 1/ 16
S.F. 2417 stewardship, the department of natural resources, and Iowa 1 state university of science and technology. 2 (b) The division shall implement demonstration projects 3 as provided in subparagraph division (a) by providing 4 for participation by persons who hold a legal interest in 5 agricultural land used in farming. To every extent practical, 6 the division shall provide for collaborative participation by 7 such persons who hold a legal interest in agricultural land 8 located within the same subwatershed. 9 (c) The division shall implement demonstration projects on 10 a cost-share basis as determined by the division. Except for 11 edge-of-field practices, the state’s share of the amount shall 12 not exceed 50 percent of the estimated cost of establishing the 13 practice as determined by the division or 50 percent of the 14 actual cost of establishing the practice, whichever is less. 15 (d) The demonstration projects shall be used to educate 16 other persons about the feasibility and value of establishing 17 similar water quality practices. The division shall promote 18 field day events for purposes of allowing interested persons to 19 establish water quality practices on their agricultural land. 20 (e) The division shall conduct water quality evaluations 21 within supported subwatersheds. Within a reasonable period 22 after accumulating information from such evaluations, the 23 division shall create an aggregated database of water quality 24 practices. Any information identifying a person holding a 25 legal interest in agricultural land or specific agricultural 26 land shall be a confidential record. 27 (4) The moneys appropriated in this lettered paragraph 28 shall be used to support education and outreach in a manner 29 that encourages persons who hold a legal interest in 30 agricultural land used for farming to implement water quality 31 practices, including the establishment of such practices in 32 watersheds generally, and not limited to subwatersheds or 33 high-priority watersheds. 34 (5) The moneys appropriated in this lettered paragraph 35 -2- LSB 5008SV (2) 88 ec/tm 2/ 16
S.F. 2417 may be used to contract with persons to coordinate the 1 implementation of efforts provided in this paragraph. 2 (6) The moneys appropriated in this lettered paragraph 3 may be used by the department to support urban soil and water 4 conservation efforts, which may include but are not limited 5 to management practices related to bioretention, landscaping, 6 the use of permeable or pervious pavement, and soil quality 7 restoration. The moneys shall be allocated on a cost-share 8 basis as provided in chapter 161A. 9 (7) Notwithstanding any other provision of law to the 10 contrary, the department may use moneys appropriated in 11 this lettered paragraph to carry out the provisions of this 12 paragraph on a cost-share basis in combination with other 13 moneys available to the department from a state or federal 14 source. 15 (8) Not more than 10 percent of the moneys appropriated in 16 this lettered paragraph may be used for costs of administration 17 and implementation of the water quality initiative administered 18 by the soil conservation division. 19 b. Section 8.57C, subsection 3, paragraph a, 29 subparagraph (2), Code 2020, is amended to read as follows: 30 (2) The fiscal year beginning July 1, 2020 2021 , and for 31 each subsequent fiscal year thereafter. 32 Sec. 11. S.F. 2417 Iowa infrastructure fund for the fiscal year beginning 1 July 1, 2020, and ending June 30, 2021, the sum of eighteen 2 million five hundred fifty thousand dollars to the technology 3 reinvestment fund, notwithstanding section 8.57, subsection 5, 4 paragraph “c” . 5 Sec. 12. STATE CAPITOL MAINTENANCE FUND. Notwithstanding 6 the standing appropriation in section 2.12B, there is 7 appropriated from the rebuild Iowa infrastructure fund for 8 deposit in the state capitol maintenance fund established in 9 section 2.12B for the fiscal year beginning July 1, 2020, the 10 sum of one hundred thousand dollars. 11 Sec. 13. ROUTINE MAINTENANCE FUND. Notwithstanding the 12 standing appropriation in section 8A.330, there is appropriated 13 from the rebuild Iowa infrastructure fund to the department of 14 administrative services for deposit in the routine maintenance 15 fund established in section 8A.330 for the fiscal year 16 beginning July 1, 2020, the sum of one million dollars. 17 DIVISION V 18 CONTINGENT EFFECTIVE DATE AND RETROACTIVE APPLICABILITY 19 Sec. 14. EFFECTIVE UPON ENACTMENT. Unless otherwise 20 provided, this Act, if approved by the governor on or after 21 July 1, 2020, takes effect upon enactment. 22 Sec. 15. RETROACTIVE APPLICABILITY. Unless otherwise 23 provided, this Act, if approved by the governor on or after 24 July 1, 2020, applies retroactively to July 1, 2020. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill relates to and makes appropriations to state 29 departments and agencies from the rebuild Iowa infrastructure 30 fund and the technology reinvestment fund, and provides for 31 related matters. The bill is organized by divisions. 32 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 33 division appropriates project funding for FY 2020-2021 from 34 the rebuild Iowa infrastructure fund for projects for the 35 -14- LSB 5008SV (2) 88 ec/tm 14/ 16
S.F. 2417 departments of agriculture and land stewardship, cultural 1 affairs, natural resources, public defense, public safety, 2 transportation, and veterans affairs, and for the economic 3 development authority, law enforcement academy, treasurer of 4 state, and the judicial branch. 5 The division appropriates project funding for multiple 6 fiscal years to the department of human services and the board 7 of regents. 8 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This 9 division appropriates project funding for FY 2020-2021 10 from the technology reinvestment fund for the departments 11 of corrections, education, homeland security and emergency 12 management, human rights, management, public health, revenue, 13 and veterans affairs, and for the Iowa telecommunications and 14 technology commission, ethics and campaign disclosure board, 15 law enforcement academy, and the judicial branch. 16 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. The 17 division makes a change to moneys appropriated from the rebuild 18 Iowa infrastructure fund to the department of administrative 19 services for major maintenance projects, the economic 20 development authority for the vacant state buildings demolition 21 and rehabilitation funds, and the board of regents for a 22 project at the Iowa state university of science and technology. 23 The division also makes a change to the reversion provision for 24 moneys appropriated from the state bond repayment fund to the 25 judicial branch for FY 2016-2017. 26 This division takes effect upon enactment. 27 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 28 8.57C, concerning the technology reinvestment fund, is amended 29 to provide that the standing appropriation to the fund from the 30 general fund for fiscal years beginning on or after July 1, 31 2020, is changed to fiscal years beginning on or after July 1, 32 2021, and to provide for an appropriation to the fund from the 33 rebuild Iowa infrastructure fund for the fiscal year beginning 34 July 1, 2020, of $18.55 million. 35 -15- LSB 5008SV (2) 88 ec/tm 15/ 16
S.F. 2417 The bill reduces the standing appropriation from the rebuild 1 Iowa infrastructure fund to the state capitol maintenance fund 2 created in Code section 2.12B for the fiscal year beginning 3 July 1, 2020, from $500,000 to $100,000. 4 The bill also reduces the standing appropriation from the 5 rebuild Iowa infrastructure fund to the routine maintenance 6 fund created in Code section 8A.330 for the fiscal year 7 beginning July 1, 2020, from $2 million to $1 million. 8 EFFECTIVE DATE AND RETROACTIVE APPLICABILITY.
