S.F. 2241 Section 1. Section 331.301, Code 2020, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 18. A county shall not adopt an ordinance, 3 motion, resolution, or amendment imposing any requirement to 4 obtain a permit or license for an eligible business operated 5 on an occasional basis for no more than eighty-nine days in a 6 calendar year by a person or persons under the age of eighteen. 7 For purposes of this subsection, “eligible business” means a 8 business that a person or persons under the age of eighteen is 9 not otherwise prohibited by law from operating. 10 Sec. 2. Section 364.3, Code 2020, is amended by adding the 11 following new subsection: 12 NEW SUBSECTION . 13. A city shall not adopt or enforce 13 an ordinance imposing any requirement to obtain a permit or 14 license for an eligible business operated on an occasional 15 basis for no more than eighty-nine days in a calendar year by a 16 person or persons under the age of eighteen. For purposes of 17 this subsection, “eligible business” means a business that a 18 person or persons under the age of eighteen is not otherwise 19 prohibited by law from operating. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill limits the authority of a county or city to adopt 24 an ordinance imposing a requirement to obtain a permit or 25 license for an eligible business operated for no more than 89 26 days in a calendar year by a person or persons under the age of 27 18.
