S.F. 2183 Section 1. Section 598.21F, Code 2020, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 8. Modification of decree. Notwithstanding 3 any provision to the contrary, when the court retains 4 jurisdiction over a dissolution of marriage following 5 the issuance of a decree that includes the ordering of a 6 postsecondary education subsidy or otherwise retains such 7 jurisdiction to address a postsecondary education subsidy, a 8 child affected by the ordering of a postsecondary education 9 subsidy who is fourteen years of age or older shall have 10 standing to file a petition to modify the decree in order 11 to pursue the child’s legally enforceable interest in a 12 postsecondary education subsidy. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill provides that when a court retains jurisdiction 17 over a dissolution of marriage following the issuance of a 18 decree that includes the ordering of a postsecondary education 19 subsidy or otherwise retains such jurisdiction to address 20 a postsecondary education subsidy, a child affected by the 21 ordering of a postsecondary education subsidy who is 14 years 22 of age or older shall have standing to file a petition to 23 modify the decree in order to pursue the child’s legally 24 enforceable interest in a postsecondary education subsidy. 25 -1- LSB 5629SV (1) 88 pf/jh 1/ 1
