Section
1.
Section
805.9,
subsection
6,
Code
2020,
is

amended
to
read
as
follows:

6.
a.
The
court
costs
imposed
by
this
section
are
the
total

costs
collectible
from
a
defendant
upon
either
an
admission
4
of
a
violation
without
hearing
,
or
upon
a
hearing
pursuant
to
5
subsection
4
in
which
a
defendant
admits
the
violation
or
is
6
convicted
of
the
violation
.

b.
A
county
attorney
shall
not
dismiss
a
scheduled
violation
8
in
exchange
for
a
defendant’s
payment
of
court
costs
pursuant
9
to
this
section.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
court
costs
for
a
scheduled
violation
are
14
the
total
costs
collectible
from
a
defendant
upon
either
an
15
admission
of
a
violation
without
a
hearing
or
upon
a
hearing.
16
This
bill
specifies
the
hearing
must
result
in
an
admission
of
17
the
violation
or
a
conviction
in
order
for
court
costs
to
be
18
assessed.
The
bill
prohibits
a
county
attorney
from
dismissing
19
a
scheduled
violation
in
exchange
for
a
defendant’s
payment
of
20
court
costs.
