Dicamba
——
prohibition.

A
person
shall
not
offer
for
sale,
sell,
purchase,
apply,
or

use
a
pesticide
containing
dicamba
in
this
state.

Sec.
2.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
4
2021.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
7
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
amends
Code
chapter
206
regulating
certain
9
pesticides,
by
prohibiting
a
person
from
offering
for
sale,
10
selling,
purchasing,
applying,
or
using
the
herbicide
dicamba,
11
which
is
used
to
kill
broad-leafed
weeds.
The
prohibition
12
is
effective
January
1,
2021.
The
Code
chapter
currently
13
prohibits
chlordane
(Code
section
206.32)
and
daminozide
(Code
14
section
206.33).
15
A
person
violating
the
bill’s
prohibition
is
guilty
of
16
a
serious
misdemeanor
(Code
section
206.22).
A
serious
17
misdemeanor
is
punishable
by
confinement
for
no
more
than
one
18
year
and
a
fine
of
at
least
$315
but
not
more
than
$1,875.
