S.F. 2043 Section 1. NEW SECTION . 481A.41 Tree stands for hunting 1 deer on public land —— identification —— prohibition. 2 1. A person shall not place a tree stand for hunting deer 3 on public land unless the stand is affixed with and exhibits a 4 metal plate that plainly shows the hunting license number of 5 the owner of the stand. The metal plate shall be affixed on 6 the front of the foot platform of the stand on the third step 7 up from the ground. A person who fails to properly identify 8 a tree stand placed on public land belonging to the person is 9 subject to a scheduled fine under section 805.8B, subsection 10 3, paragraph “b” . 11 2. An owner of a tree stand placed on public land may 12 prohibit any other person from using the tree stand. A 13 person who uses a tree stand without the owner’s permission is 14 subject to a scheduled fine under section 805.8B, subsection 15 3, paragraph “e” . 16 3. The natural resource commission shall adopt rules 17 pursuant to chapter 17A to implement this section. 18 Sec. 2. Section 805.8B, subsection 3, paragraphs b and e, 19 Code 2020, are amended to read as follows: 20 b. For violations of section 481A.41, subsection 1, sections 21 481A.54 , 481A.69 , 481A.71 , 481A.72 , 482.6 , 483A.3 , 483A.6 , 22 483A.8A , 483A.19 , 483A.27 , and 483A.27A , the scheduled fine is 23 twenty dollars. 24 e. For violations of section 481A.41, subsection 2, sections 25 481A.57 , 481A.85 , 481A.93 , 481A.95 , 481A.120 , 481A.137 , 481B.5 , 26 482.3 , 482.9 , 482.15 , and 483A.42 , the scheduled fine is one 27 hundred dollars. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to the identification and use of tree 32 stands for hunting deer placed on public land. 33 The bill requires that a stand placed on public land for 34 hunting deer be affixed with and exhibit a metal plate that 35 -1- LSB 5093XS (2) 88 js/rn 1/ 2
S.F. 2043 plainly shows the hunting license number of the owner of the 1 stand. The metal plate must be affixed on the front of the foot 2 platform of the stand on the third step up from the ground. An 3 owner who does not properly identify a tree stand placed on 4 public land belonging to the owner is subject to a scheduled 5 fine of $20. 6 The bill allows an owner of a tree stand placed on public 7 land to prohibit any other person from using the tree stand.
