Section 68A.405, subsection 1, paragraph a, 1 unnumbered paragraph 1, Code 2019, is amended to read as 2 follows: 3 For purposes of this subsection section : 4 Sec. 2. Section 68A.405, subsection 1, paragraph a, 5 subparagraph (3), Code 2019, is amended to read as follows: 6 (3) “Published material” means any newspaper, magazine, 7 shopper, outdoor advertising facility, poster, direct mailing, 8 brochure, internet site, campaign sign, or any other form of 9 printed or electronic general public political advertising. 10 “Published material” includes television, video, or motion 11 picture advertising , live telephone calls, automated telephone 12 calls, or text messages . 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 Under current law, published material designed to expressly 17 advocate the nomination, election, or defeat of a candidate 18 for public office or the passage or defeat of a ballot issue 19 is required to include an attribution statement indicating 20 who is responsible for the published material. This bill 21 adds live telephone calls, automated telephone calls, and 22 text messages to the definition of “published material”. A 23 person who violates a provision of Code chapter 68A is subject 24 to civil penalties imposed by the Iowa ethics and campaign 25 disclosure board, including remedial action, a reprimand, and 26 a civil penalty of up to $2,000. In addition, a person who 27 willfully violates a provision of Code chapter 68A is guilty 28 of a serious misdemeanor.
