H.F. 82 Section 1. NEW SECTION . 481A.56A Retrieval of wounded deer 1 by leashed dogs. 2 A person having a valid hunting license and a valid deer 3 hunting license who has wounded a deer while hunting may use a 4 dog to locate and retrieve the wounded deer. The hunter or any 5 person in the company of the hunter shall not possess a firearm 6 or bow while using a dog in this manner and shall have the 7 dog leashed and under control at all times during the search. 8 A person shall obtain permission from the owner or tenant of 9 private property before using a dog to locate a wounded deer 10 on the private property. The commission shall adopt rules 11 pursuant to chapter 17A to implement this section. 12 Sec. 2. Section 805.8B, subsection 3, paragraph c, Code 13 2019, is amended to read as follows: 14 c. For violations of sections 481A.6 , 481A.21 , 481A.22 , 15 481A.26 , 481A.50 , 481A.56 , 481A.56A, 481A.60 through , 481A.61, 16 481A.62 , 481A.83 , 481A.84 , 481A.92 , 481A.123 , 481A.145, 17 subsection 3 , sections 483A.6A , 483A.7 , 483A.8 , 483A.23 , 18 483A.24 , and 483A.28 , the scheduled fine is twenty-five 19 dollars. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill creates new Code section 481A.56A to allow a 24 hunter with a valid hunting license and deer hunting license 25 who wounds a deer while hunting to use a dog to locate and 26 retrieve the wounded deer. The hunter or any person in the 27 company of the hunter shall not possess a firearm or bow while 28 using a dog in this manner and shall have the dog leashed and 29 under control at all times during the search. A person must 30 obtain permission from the owner or tenant before using a dog 31 to locate a wounded deer on private property. The natural 32 resource commission shall adopt rules pursuant to Code chapter 33 17A to implement this provision. 34 A violation of the new provision is punishable by a scheduled 35 -1- LSB 1738YH (2) 88 js/rn 1/ 2
