H.F. 2437 Section 1. NEW SECTION . 153.24 Orthodontia-related 1 services. 2 1. A licensee under the purview of the board who provides 3 treatment for the correction of malpositions of human teeth 4 or the initial use of orthodontic appliances shall not begin 5 orthodontic treatment on a new patient unless one of the 6 following conditions is met: 7 a. The licensee performs an initial in-person examination of 8 the teeth and supporting structures of the new patient prior to 9 beginning orthodontic treatment. 10 b. The new patient provides the licensee with a record of 11 completion within the prior two-year period of an in-person 12 examination of the teeth and supporting structures of the new 13 patient prior to the licensee beginning orthodontic treatment. 14 2. The in-person examination required pursuant to 15 subsection 1 shall include any appropriate conventional or 16 digital radiographs that are necessary to develop a suitable 17 orthodontic diagnosis and treatment plan. 18 3. For the purposes of this section, “new patient” means a 19 person whom a licensee has not examined, for whom a licensee 20 has not provided care, or for whom a licensee has not otherwise 21 provided consultation during the two-year period immediately 22 prior to the patient’s most recent appointment. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill prohibits a licensee under the purview of the 27 dental board who provides treatment for the correction of 28 malpositions of human teeth or the initial use of orthodontic 29 appliances from beginning orthodontic treatment on a new 30 patient unless either the licensee performs an initial 31 in-person examination of the teeth and supporting structures 32 of the new patient prior to beginning orthodontic treatment, 33 or the new patient provides the licensee with a record of 34 completion within the prior two-year period of an in-person 35 -1- LSB 5983HV (2) 88 pf/rh 1/ 2

The required in-person examination shall include 3 any appropriate conventional or digital radiographs that are 4 necessary to develop a suitable orthodontic diagnosis and 5 treatment plan.
