1.
Section
261.86,
subsection
3,
paragraph
a,
Code

2020,
is
amended
to
read
as
follows:

a.
(1)
Except
as
provided
in
subparagraph
(2),
an

eligible
member
of
the
national
guard,
attending
an
institution
4
as
provided
in
subsection
1
,
paragraph
“d”
,
shall
not
receive
5
scholarship
awards
under
this
section
for
more
than
one
6
hundred
twenty
thirty
semester,
or
the
equivalent,
credit
7
hours
of
undergraduate
study.
Only
courses
that
lead
to
an
8
undergraduate
certificate
or
degree
or
to
a
commission
in
the
9
armed
services
of
the
United
States
are
eligible
for
award
10
funding
under
this
program.

(2)
An
eligible
member
of
the
national
guard,
attending
an
12
institution
as
provided
in
subsection
1
,
paragraph
“d”
,
who
is
13
enrolled
in
a
program
of
education
leading
to
a
postsecondary
14
degree
that
meets
the
eligibility
requirements
for
the
federal
15
Edith
Nourse
Rogers
STEM
scholarship
established
under
38
16
U.S.C.
§3320
,
shall
not
receive
scholarship
awards
issued
under
17
this
section
for
more
than
one
hundred
thirty
semester,
or
the
18
equivalent,
credit
hours
of
undergraduate
study.

(3)
A
national
guard
member
who
has
met
the
educational
20
requirements
for
a
baccalaureate
degree
is
ineligible
for
a
21
scholarship
award
under
this
section
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
24
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
increases
the
number
of
credit
hours
certain
26
national
guard
members
may
receive
scholarship
awards
for
27
under
the
national
guard
service
scholarship
program
from
120
28
credit
hours
of
undergraduate
study
to
130
credit
hours
of
29
undergraduate
study,
and
provides
that
award
funding
can
only
30
be
used
for
courses
leading
to
an
undergraduate
certificate
or
31
degree
or
to
a
commission
in
the
United
States
armed
services.

Currently,
only
national
guard
members
who
are
enrolled
33
in
a
program
of
education
leading
to
a
postsecondary
degree
34
that
meets
the
eligibility
requirements
for
a
federal
