1.
BACKGROUND
INFORMATION
PROVIDED
TO
MENTAL
HEALTH

AND
SUBSTANCE
USE
DISORDER
TREATMENT
PROVIDERS.

1.
The
department
of
corrections
and
the
department
of
3
human
services
shall
amend
their
administrative
rules
pursuant
4
to
chapter
17A
to
require
the
department
of
corrections,
a
5
judicial
district
department
of
correctional
services,
and
the
6
department
of
human
services
to
provide
specific
background
7
information
to
mental
health
and
substance
use
disorder
8
treatment
providers
at
the
time
of
referral
of
an
individual
9
for
evaluation
and
treatment.
The
background
information
shall
10
include
all
of
the
following:

2.
The
name
of
the
individual
referred
for
services,
12
the
individual’s
last
known
address,
and
any
other
contact
13
information.
14
3.
The
rationale
for
making
the
referral.
15
4.
The
reason
for
the
department’s
or
agency’s
involvement
16
with
the
individual.
17
5.
The
individual’s
current
involvement
with
the
department
18
or
agency.
19
6.
Any
corroborating
information
that
supports
the
20
referral.
21
7.
The
information
that
the
referring
department
or
22
agency
seeks
to
receive
from
the
treatment
provider
providing
23
the
evaluation
and
treatment.
The
disclosure
of
any
such
24
information
shall
be
consistent
with
the
confidentiality
25
protections
under
state
and
federal
law.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
28
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
background
information
provided
to
30
mental
health
and
substance
use
disorder
treatment
providers.

The
bill
requires
the
department
of
corrections,
a
judicial
32
district
department
of
correctional
services,
and
the
33
department
of
human
services
to
provide
specific
background
34
information
concerning
an
individual
who
is
referred
to
a

evaluation
and
treatment.
The
referring
department
or
agency

is
directed
to
provide
information
to
the
treatment
provider

who
is
requested
to
evaluate
and
provide
treatment
to
the

individual
including
the
name
of
the
individual
referred
for
5
services,
the
individual’s
last
known
address,
and
any
other
6
contact
information;
the
rationale
for
making
the
referral;
7
the
reason
for
the
department’s
or
agency’s
involvement
8
with
the
individual;
the
individual’s
current
involvement
9
with
the
department
or
agency;
any
corroborating
information
10
that
supports
the
referral;
and
the
information
that
the

referring
department
or
agency
seeks
to
receive
from
the

treatment
provider

The
