H.F. 2154 Section 1. Section 256.9, subsection 46, paragraph a, Code 1 2020, is amended to read as follows: 2 a. Develop and make available to school districts, examples 3 of age-appropriate and research-based materials and lists 4 of resources which parents may use to teach their children 5 to recognize unwanted physical and verbal sexual advances, 6 to not make unwanted physical and verbal sexual advances, 7 to effectively reject unwanted sexual advances, that it is 8 wrong to take advantage of or exploit another person, about 9 the dangers of sexual exploitation by means of the internet 10 including specific strategies to help students protect 11 themselves and their personally identifiable information 12 from such exploitation, and about counseling, medical, and 13 legal resources available to survivors of sexual abuse and 14 sexual assault, including resources for escaping violent 15 relationships. The materials and resources shall cover verbal, 16 physical, and visual sexual harassment, including nonconsensual 17 sexual advances, and nonconsensual physical sexual contact 18 and shall also cover child sexual abuse and child sexual 19 assault awareness and prevention . In developing the materials 20 and resource list, the director shall consult with entities 21 that shall include but not be limited to the departments of 22 human services, public health, and public safety, education 23 stakeholders, and parent-teacher organizations. School 24 districts shall provide age-appropriate and research-based 25 materials and a list of available community and internet-based 26 resources to parents at registration and shall also include 27 the age-appropriate and research-based materials and resource 28 list in the student handbook. School districts are encouraged 29 to work with their communities to provide voluntary parent 30 education sessions to provide parents with the skills and 31 appropriate strategies to teach their children as described 32 in this subsection . School districts shall incorporate the 33 age-appropriate and research-based materials into relevant 34 curricula and shall reinforce the importance of preventive 35 -1- LSB 5729YH (3) 88 as/rh 1/ 3
H.F. 2154 measures when reasonable with parents and students. 1 Sec. 2. Section 272.2, Code 2020, is amended by adding the 2 following new subsection: 3 NEW SUBSECTION . 23. Adopt rules establishing continuing 4 education requirements for renewal of a license, certificate, 5 statement of professional recognition, or authorization. 6 Continuing education activities may include but are not limited 7 to participating in or presenting at in-service training 8 programs on child sexual abuse and sexual assault awareness and 9 prevention. 10 Sec. 3. Section 279.50, subsection 2, Code 2020, is amended 11 to read as follows: 12 2. Each school board shall provide age-appropriate and 13 research-based instruction in human growth and development 14 including instruction regarding human the following: 15 a. Human sexuality, self-esteem, stress management, 16 interpersonal relationships, domestic abuse, HPV and the 17 availability of a vaccine to prevent HPV, and acquired immune 18 deficiency syndrome as required in section 256.11 , in grades 19 one through twelve. 20 b. Child sexual abuse and child sexual assault awareness 21 and prevention in kindergarten through grade twelve, and in 22 prekindergarten if the school district offers a prekindergarten 23 program. 24 Sec. 4. STATE MANDATE FUNDING SPECIFIED. In accordance 25 with section 25B.2, subsection 3, the state cost of requiring 26 compliance with any state mandate included in this Act shall 27 be paid by a school district from state school foundation aid 28 received by the school district under section 257.16. This 29 specification of the payment of the state cost shall be deemed 30 to meet all of the state funding-related requirements of 31 section 25B.2, subsection 3, and no additional state funding 32 shall be necessary for the full implementation of this Act 33 by and enforcement of this Act against all affected school 34 districts. 35 -2- LSB 5729YH (3) 88 as/rh 2/ 3
H.F. 2154 EXPLANATION 1 The inclusion of this explanation does not constitute agreement with 2 the explanation’s substance by the members of the general assembly. 3 This bill relates to child sexual abuse and sexual assault 4 awareness and prevention by providing that continuing education 5 activities authorized by the board of educational examiners 6 for purposes of renewing a license, certificate, statement 7 of professional recognition, or authorization may include 8 participating in or presenting at in-service training programs 9 on child sexual abuse and child sexual assault awareness and 10 prevention. The bill also requires school districts to provide 11 age-appropriate and research-based instruction in child sexual 12 abuse and child sexual assault awareness and prevention as part 13 of its human growth and development instruction in kindergarten 14 through grade 12, and in prekindergarten if the school district 15 offers a prekindergarten program. 16 Currently, the director of the department of education has a 17 duty to develop and make available to school districts examples 18 of age-appropriate and research-based materials. The bill 19 specifies that the age-appropriate and research-based materials 20 and resources shall also cover child sexual abuse and child 21 sexual assault awareness and prevention. 22 The bill may include a state mandate as defined in Code 23 section 25B.3. The bill requires that the state cost of 24 any state mandate included in the bill be paid by a school 25 district from state school foundation aid received by the 26 school district under Code section 257.16. The specification 27 is deemed to constitute state compliance with any state mandate 28 funding-related requirements of Code section 25B.2. The 29 inclusion of this specification is intended to reinstate the 30 requirement of political subdivisions to comply with any state 31 mandates included in the bill. 32 -3- LSB 5729YH (3) 88 as/rh 3/ 3
