H.F. 2092 Section 1. Section 249A.30A, Code 2020, is amended to read 1 as follows: 2 249A.30A Medical assistance —— personal needs allowance. 3 The personal needs allowance under the medical assistance 4 program, which may be retained by a person who is a resident 5 of a nursing facility, an intermediate care facility for 6 persons with an intellectual disability, or an intermediate 7 care facility for persons with mental illness, as defined in 8 section 135C.1 , or a person who is a resident of a psychiatric 9 medical institution for children as defined in section 135H.1 , 10 shall be fifty sixty dollars per month. A resident who has 11 income of less than fifty sixty dollars per month shall receive 12 a supplement from the state in the amount necessary to receive 13 a personal needs allowance of fifty sixty dollars per month, if 14 funding is specifically appropriated for this purpose. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill increases the personal needs allowance under the 19 Medicaid program which may be retained by a person who is a 20 resident of a nursing facility, an intermediate care facility 21 for persons with an intellectual disability, or an intermediate 22 care facility for persons with mental illness, or a person who 23 is a resident of a psychiatric medical institution for children 24 from $50 to $60 per month. Additionally, under the bill, 25 a resident who has income of less than $60 per month shall 26 receive a supplement from the state in the amount necessary to 27 receive a personal needs allowance of $60 per month, if funding 28 is specifically appropriated for this purpose. 29 -1- LSB 5201YH (1) 88 pf/rh 1/ 1
