1.
A
physician
who
provides
surgical
services
to
patients
at
3
an
ambulatory
surgical
center
shall
at
the
time
the
surgical
4
services
are
performed
have
active
admitting
privileges
at
a
5
hospital
licensed
under
chapter
135B
that
is
located
closest
in
6
proximity
to
the
ambulatory
surgical
center.

2.
For
the
purposes
of
this
section,
“ambulatory
surgical
8
center”
means
a
distinct
facility
that
operates
exclusively
9
for
the
purpose
of
providing
surgical
services
to
patients
not
10
requiring
hospitalization
and
in
which
the
expected
duration
11
of
services
does
not
exceed
twenty-four
hours
following
an
12
admission.
“Ambulatory
surgical
center”
does
not
include
13
individual
or
group
practice
offices
of
private
physicians
14
or
podiatrists
that
do
not
contain
a
distinct
area
used
for
15
outpatient
surgical
treatment
on
a
regular
basis,
or
that
16
only
provide
surgery
routinely
provided
in
a
physician’s
17
or
podiatrist’s
office
using
local
anesthesia
or
conscious
18
sedation;
individual
or
group
practice
offices
of
private
19
dentists;
or
a
portion
of
a
licensed
hospital
designated
for
20
outpatient
surgical
treatment.

A
physician
who
violates
this
section
is
subject
to
22
licensee
discipline
pursuant
to
section
148.6.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance

the
members
of
the
general
assembly.

This
bill
relates
to
requirements
for
physicians
providing
27
surgical
services
at
an
ambulatory
surgical
center.
The
bill
28
requires
a
physician
who
provides
surgical
services
to
patients
29
at
an
ambulatory
surgical
center
at
the
time
the
surgical
30
services
are
performed
to
have
active
admitting
privileges
at
31
a
licensed
hospital
that
is
located
closest
in
proximity
to
32
the
ambulatory
surgical
center.
The
bill
defines
“ambulatory
33
surgical
center”
for
the
purposes
of
the
bill.
A
physician
who
34
violates
the
bill
is
subject
to
licensee
discipline.
