S.F. 514 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the fiscal year beginning July 1, 2017, and ending June 6 30, 2018, the following amounts, or so much thereof as is 7 necessary, to be used for the purposes designated: 8 1. DEPARTMENT OF ADMINISTRATIVE SERVICES 9 For major maintenance projects: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,010,000 11 Of the moneys appropriated in this subsection, $2,000,000 12 is allocated for the cost to modernize, upgrade, or replace 13 elevator systems in facilities on the state capitol complex. 14 The department shall give priority for projects modernizing 15 elevator systems wherever possible. 16 2. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 17 a. (1) For deposit in the water quality initiative fund 18 created in section 466B.45 for purposes of supporting the 19 water quality initiative administered by the division of soil 20 conservation and water quality as provided in section 466B.42, 21 including salaries, support, maintenance, and miscellaneous 22 purposes, notwithstanding section 8.57, subsection 5, paragraph 23 “c”: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 25 (2) (a) The moneys appropriated in this lettered 26 paragraph shall be used to support demonstration projects in 27 subwatersheds as designated by the department that are part 28 of high-priority watersheds identified by the water resources 29 coordinating council. 30 (b) The moneys appropriated in this lettered paragraph 31 shall be used to support demonstration projects in watersheds 32 generally, including regional watersheds, as designated by the 33 division and high-priority watersheds identified by the water 34 resources coordinating council. 35 -1- LSB 1054SV (1) 87 ec/tm 1/ 16
S.F. 514 (3) In supporting projects in watersheds and subwatersheds 1 as provided in subparagraph (2), subparagraph divisions (a) and 2 (b), all of the following shall apply: 3 (a) The demonstration projects shall utilize water quality 4 practices as described in the latest revision of the document 5 entitled “Iowa Nutrient Reduction Strategy” initially presented 6 in November 2012 by the department of agriculture and land 7 stewardship, the department of natural resources, and Iowa 8 state university of science and technology. 9 (b) The division shall implement demonstration projects 10 as provided in subparagraph division (a) by providing 11 for participation by persons who hold a legal interest in 12 agricultural land used in farming. To every extent practical, 13 the division shall provide for collaborative participation by 14 such persons who hold a legal interest in agricultural land 15 located within the same subwatershed. 16 (c) The division shall implement demonstration projects on 17 a cost-share basis as determined by the division. However, 18 the state’s share of the amount, except for edge-of-field 19 practices, shall not exceed 50 percent of the estimated cost 20 of establishing the practice as determined by the division or 21 50 percent of the actual cost of establishing the practice, 22 whichever is less. 23 (d) The demonstration projects shall be used to educate 24 other persons about the feasibility and value of establishing 25 similar water quality practices. The division shall promote 26 field day events for purposes of allowing interested persons to 27 establish water quality practices on their agricultural land. 28 (e) The division shall conduct water quality evaluations 29 within supported subwatersheds. Within a reasonable period 30 after accumulating information from such evaluations, the 31 division shall create an aggregated database of water quality 32 practices. Any information identifying a person holding a 33 legal interest in agricultural land or specific agricultural 34 land shall be a confidential record. 35 -2- LSB 1054SV (1) 87 ec/tm 2/ 16
S.F. 514 (4) The moneys appropriated in this lettered paragraph 1 shall be used to support education and outreach in a manner 2 that encourages persons who hold a legal interest in 3 agricultural land used for farming to implement water quality 4 practices, including the establishment of such practices in 5 watersheds generally, and not limited to subwatersheds or 6 high-priority watersheds. 7 (5) The moneys appropriated in this lettered paragraph 8 may be used to contract with persons to coordinate the 9 implementation of efforts provided in this paragraph. 10 (6) The moneys appropriated in this lettered paragraph 11 may be used by the department to support urban soil and water 12 conservation efforts, which may include but are not limited 13 to management practices related to bioretention, landscaping, 14 the use of permeable or pervious pavement, and soil quality 15 restoration. The moneys shall be allocated on a cost-share 16 basis as provided in chapter 161A. 17 (7) Notwithstanding any other provision of law to the 18 contrary, the department may use moneys appropriated in 19 this lettered paragraph to carry out the provisions of this 20 paragraph on a cost-share basis in combination with other 21 moneys available to the department from a state or federal 22 source. 23 (8) Not more than 10 percent of the moneys appropriated in 24 this lettered paragraph may be used for costs of administration 25 and implementation of the water quality initiative administered 26 by the soil conservation division. 27 b. From any moneys appropriated 10 in this subsection and remaining upon completion of the 11 repair and renovation of the dome of the Iowa state capitol, 12 the department shall expend such amount as is necessary for 13 maintenance projects for the Iowa state capitol and the Ola 14 Babcock Miller building. 15 Sec. 14. Section 8.57, subsection 5, paragraph c, Code 2017, 25 is amended to read as follows: 26 c. Moneys in the rebuild Iowa infrastructure fund in a 27 fiscal year shall be used as directed by the general assembly 28 for public vertical infrastructure projects. For the purposes 29 of this subsection , “vertical infrastructure” includes only land 30 acquisition and construction; major renovation and major repair 31 of buildings; routine, recurring maintenance; all appurtenant 32 structures; utilities; site development; recreational trails; 33 renewable fuel infrastructure programs; and debt service 34 payments on academic revenue bonds issued in accordance 35 -13- LSB 1054SV (1) 87 ec/tm 13/ 16
S.F. 514 with chapter 262A for capital projects at board of regents 1 institutions. “Vertical infrastructure” does not include 2 operational expenses or leasing of a building, appurtenant 3 structure, or utility without a lease-purchase agreement. 4 Sec. 16. Section 8.57C, subsection 3, paragraph a, 5 subparagraph (2), Code 2017, is amended to read as follows: 6 (2) The fiscal year beginning July 1, 2017 2018 , and for 7 each subsequent fiscal year thereafter. 8 Sec. 17. Section 8.57C, subsection 3, Code 2017, is amended 9 by adding the following new paragraph: 10 NEW PARAGRAPH . f. There is appropriated from the rebuild 11 Iowa infrastructure fund for the fiscal year beginning July 1, 12 2017, and ending June 30, 2018, the sum of ten million dollars 13 to the technology reinvestment fund, notwithstanding section 14 8.57, subsection 5, paragraph “c” . 15 Sec. 18. Section 12.88, Code 2017, is amended by adding the 16 following new subsection: 17 NEW SUBSECTION . 6. For the fiscal year beginning July 1, 18 2017, any unobligated and unencumbered moneys in the fund from 19 the previous fiscal year are appropriated to the department of 20 administrative services for major maintenance projects. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill relates to and makes appropriations to state 25 departments and agencies from the rebuild Iowa infrastructure 26 fund and the revenue bonds capitals fund, and provides for 27 related matters. The bill is organized by divisions. 28 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 29 division appropriates project funding for FY 2017-2018 from 30 the rebuild Iowa infrastructure fund for projects for the 31 departments of administrative services, agriculture and land 32 stewardship, the blind, cultural affairs, human rights, human 33 services, natural resources, public defense, public safety, and 34 transportation, and for the economic development authority, 35 -14- LSB 1054SV (1) 87 ec/tm 14/ 16

This division 2 appropriates project funding for FY 2017-2018 from the 3 technology reinvestment fund for the departments of education, 4 human rights, human services, management, public health, public 5 safety, and homeland security and emergency management, and 6 for the office of the chief information officer and the state 7 public defender. 8 DIVISION III —— MISCELLANEOUS APPROPRIATIONS. This division 9 appropriates project funding for FY 2016-2017 from the revenue 10 bonds capitals fund to the department of administrative 11 services for major maintenance projects and for FY 2017-2018 12 from the state bond repayment fund for the state board of 13 regents for tuition replacement. This division takes effect 14 upon enactment. 15 DIVISION IV —— CHANGES TO PRIOR APPROPRIATIONS. This 16 division makes a change to moneys appropriated from the 17 rebuild Iowa infrastructure fund to the board of regents for 18 a project at the state university of Iowa and projects at 19 the Iowa state university of science and technology for FY 20 2017-2018 and FY 2021-2022. The division also makes a change 21 to moneys appropriated from the state bond repayment fund to 22 the department of administrative services for repair of the 23 dome of the Iowa state capitol for FY 2016-2017 to authorize 24 expenditure of moneys remaining upon completion of repairs to 25 the dome for maintenance projects for the Iowa state capitol 26 and the Ola Babcock Miller building. This provision takes 27 effect upon enactment. 28 This division also makes a change to moneys appropriated 29 from the rebuild Iowa infrastructure fund to the department of 30 administrative services for major maintenance projects for FY 31 2016-2017. Code section 8.57, 1 concerning the rebuild Iowa infrastructure fund, is amended 2 to provide that the definition of “vertical infrastructure” 3 specifically includes renewable fuel infrastructure programs. 4 Code section 8.57C, concerning the technology reinvestment 5 fund, is amended to provide that the appropriation to the 6 fund from the general fund for fiscal years beginning on or 7 after July 1, 2017, is changed to fiscal years beginning on 8 or after July 1, 2018, and to provide for an appropriation to 9 the fund from the rebuild Iowa infrastructure fund for the 10 fiscal year beginning July 1, 2017, of $10 million.
