Section
1.
NEW
SECTION
.
100B.15
Fire
and
emergency
response
1
services
training
grant
fund.
2
1.
A
fire
and
emergency
response
services
training
grant
3
fund
is
created
in
the
state
treasury
under
the
control
of
4
the
department
of
public
safety.
The
fund
shall
consist
of
5
fees
transferred
pursuant
to
section
144.45A,
section
147A.6,
6
subsection
1,
section
321.34,
subsection
10A,
paragraph
“b”
,
7
amounts
appropriated
by
the
general
assembly,
and
other
moneys
8
available
from
other
sources
accepted
for
deposit
in
the
fund.

Moneys
in
the
fund
are
appropriated
to
the
department
of
public
10
safety
and
shall
be
used
exclusively
by
the
department
for
fire
11
and
emergency
response
services
training
grants.
12
2.
A
fire
fighter,
or
a
volunteer
fire
fighter
or
emergency
13
medical
services
personnel
member
as
defined
in
section
422.12,
14
may
apply
to
the
department
for
a
grant
to
reimburse
the
15
fire
fighter,
volunteer
fire
fighter,
or
emergency
medical
16
services
personnel
member
for
training
expenses
incurred
in
17
completing
required
training
in
this
state.
For
purposes
of
18
this
subsection,
“training
expenses”
shall
include
costs
of
19
the
required
training
to
become
or
maintain
status
as
a
fire
20
fighter,
volunteer
fire
fighter,
or
emergency
medical
services
21
personnel
member
in
this
state
including
but
not
limited
to
22
training
required
under
section
100B.6,
as
well
as
any
travel
23
and
lodging
expenses
directly
related
to
completion
of
the
24
training,
and
actually
paid
by
a
fire
fighter,
volunteer
fire
25
fighter,
or
emergency
medical
services
personnel
member.

3.
Notwithstanding
section
8.33,
moneys
in
the
fund
shall
27
not
revert
to
the
general
fund
of
the
state
at
the
end
of
the
28
fiscal
year,
but
shall
remain
available
for
expenditure
by
the
29
department
in
future
fiscal
years.
30
4.
The
department
of
public
safety
shall
adopt
rules
31
pursuant
to
chapter
17A
to
administer
this
section.

2.
Section
144.45A,
Code
2017,
is
amended
to
read
as

follows:

application

payment
of
a
thirty-five
dollar
fee,

the
director
may
issue
a
commemorative
copy
of
a
certificate
of

birth
or
a
certificate
of
marriage.
Fees
collected
pursuant

to
this
section
shall
be
deposited
in
the
emergency
medical
4
services
fund
established
in
section
135.25
to
support
the
5
development
and
enhancement
of
emergency
medical
services
6
systems
and
emergency
medical
services
for
children
fire
and
7
emergency
response
services
training
grant
fund
created
in
8
section
100B.15
.

Sec.
3.
Section
147A.6,
subsection
1,
Code
2017,
is
amended

to
read
as
follows:

1.
The
department,
upon
application
and
receipt
of
the
12
prescribed
fee,
shall
issue
a
certificate
to
an
individual
who
13
has
met
all
of
the
requirements
for
emergency
medical
care
14
provider
certification
established
by
the
rules
adopted
under
15
section
147A.4,
subsection
2
.
All
fees
received
pursuant
16
to
this
section
shall
be
deposited
in
the
emergency
medical
17
services
fund
established
in
section
135.25
fire
and
emergency
18
response
services
training
grant
fund
created
in
section
19
100B.15
.

4.
Section
147A.23,
subsection
2,
paragraph
d,
Code

2017,
is
amended
to
read
as
follows:

The
department
is
responsible
for
the
funding
of
the

costs
of

subchapter

Any
funds
received

the
department
for
this
purpose
shall
be
deposited
in

in

5.
NEW

.
147A.23A
Trauma
care
system

development
fund.

A
trauma
care
system
development
fund
is
created
in
the
31
state
treasury
under
the
control
of
the
department.
The
fund

shall
include
amounts
appropriated
from
the
general
assembly
33
and
any
other
funds
received
by
the
department
for
deposit
34
in
the
fund.
Moneys
remaining
in
the
fund
at
the
end
of
35

each
fiscal
year
shall
not
revert
to
the
general
fund
of
the

state
but
shall

the
trauma
care
system
development

fund,
notwithstanding

department

shall
be
used
for
the

purposes
described
in
this
subchapter.

6.
Section
321.34,
subsection
10A,
paragraph
b,
Code

2017,
is
amended
to
read
as
follows:

b.
The
special
fees
collected
by
the
director
under
this
8
subsection
shall
be
paid
monthly
to
the
treasurer
of
state
and
9
deposited
in
the
road
use
tax
fund.
The
treasurer
of
state
10
shall
transfer
monthly
from
the
statutory
allocations
fund
11
created
under
section
321.145,
subsection
2
,
to
the
emergency
12
medical
services
fund
created
in
section
135.25
fire
and
13
emergency
response
services
training
grant
fund
created
in
14
section
100B.15
the
amount
of
the
special
fees
collected
in
15
the
previous
month
for
issuance
of
emergency
medical
services
16
plates.

Sec.
7.
REPEAL.
Sections
100B.12
and
135.25,
Code
2017,
18
are
repealed.

Sec.
8.
TRANSFER
OF
REMAINING
FUNDS.
Any
unobligated
20
or
unencumbered
moneys
remaining
in
the
Paul
Ryan
memorial
21
fire
fighter
safety
training
fund
in
section
100B.12
and
the
22
emergency
medical
services
fund
in
section
135.25
at
the
end
23
of
the
fiscal
year
beginning
July
1,
2016,
and
ending
June
30,
24
2017,
shall
be
transferred
to
the
fire
and
emergency
response
25
services
training
grant
fund
enacted
in
this
Act.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
creates
a
fire
and
emergency
response
services
30
training
fund
under
the
control
of
the
department
of
public
31
safety
(DPS)
to
reimburse
fire
fighters,
and
volunteer
fire
32
fighters
and
emergency
medical
services
personnel
members
33
as
defined
in
the
bill,
for
training
expenses
incurred
in
34
completing
required
training
in
this
state
to
become
or
35

maintain
status
as
a
fire
fighter,
volunteer
fire
fighter,
or
1
emergency
medical
services
personnel
member.
The
bill
allows
2
a
fire
fighter,
volunteer
fire
fighter,
or
emergency
medical
3
services
personnel
member
to
apply
to
DPS
for
a
grant
from
the
4
fund
to
be
reimbursed
for
training
expenses,
as
defined
in
5
the
bill,
actually
paid
by
the
fire
fighter,
volunteer
fire
6
fighter,
or
emergency
medical
services
personnel
member.
The
7
bill
requires
DPS
to
adopt
rules
for
the
administration
of
the
8
fund.

The
bill
repeals
the
Paul
Ryan
memorial
fire
fighter
safety
10
training
fund
in
Code
section
100B.12
and
the
emergency
11
medical
services
fund
in
Code
section
135.25,
and
transfers
any
12
unobligated
or
unencumbered
moneys
remaining
in
those
funds
at
13
the
end
of
FY
2016-2017
to
the
new
fire
and
emergency
response
14
services
training
grant
fund.
15
The
bill
also
provides
that
the
statutory
transfers
16
provided
for
deposit
into
the
repealed
funds
shall
instead
17
be
made
for
deposit
into
the
new
fire
and
emergency
response
18
services
training
fund.
These
transfers
include
the
transfer
19
in
Code
section
144.45A
of
fees
collected
on
the
issuance
of
20
commemorative
copies
of
birth
and
marriage
certificates,
the
21
transfer
in
Code
section
147A.6(1)
of
fees
collected
on
the
22
issuance
of
emergency
medical
care
provider
certificates,
and
23
the
transfer
in
Code
section
321.34(10A)(b)
of
fees
collected
24
on
the
issuance
of
special
emergency
medical
services
license
25
plates.
26
The
bill
also
creates
a
new
trauma
care
system
development
27
fund
in
Code
section
147A.23A
that
shall
contain
any
funds
28
received
by
the
department
of
public
health
for
purposes
of
the
29
statewide
trauma
care
system
(Code
chapter
147A,
subchapter
30
II).
These
funds
were
previously
deposited
in
the
emergency
31
medical
services
fund
in
Code
section
135.25.
