Section
1.
Section
103A.8A,
Code
2018,
is
amended
to
read
1
as
follows:

103A.8A
Energy
conservation
requirements.
3
1.
a.
The
state
building
code
commissioner
shall
adopt
4
as
a
part
of
the
state
building
code
a
requirement
that
5
new
single-family
or
two-family
residential
construction
6
shall
comply
with
energy
conservation
requirements.
The
7
requirements
shall
be
adopted
by
the
commissioner
and
approved
8
by
the
council
no
later
than
July
1,
2018,
and
shall
be
9
based
upon
a
nationally
recognized
standard
or
code
for
10
energy
conservation.
The
requirements
shall
only
apply
to
11
single-family
or
two-family
residential
construction
commenced
12
after
the
adoption
of
the
requirements
the
international
13
energy
conservation
code,
2018
edition
.
In
approving
the
14
requirements,
the
council
may
make
modifications
to
such
15
requirements
as
the
council
deems
necessary
by
a
majority
vote
16
of
the
members.
17
b.
Notwithstanding
any
other
provision
of
this
chapter
to
18
the
contrary,
the
energy
conservation
requirements
adopted
19
by
the
commissioner
and
approved
by
the
council
pursuant
to
20
paragraph
“a”
shall
apply
to
new
single-family
or
two-family
21
residential
construction
commenced
on
or
after
July
1,
2008,
22
and
shall
supersede
and
replace
any
minimum
requirements
for
23
energy
conservation
adopted
or
enacted
by
a
governmental
24
subdivision
prior
to
that
date
applicable
to
such
construction
25
2018
.
The
state
building
code
commissioner
may
provide
26
training
to
builders,
contractors,
and
other
interested
persons
27
on
the
adopted
energy
conservation
requirements.

2.
Notwithstanding
subsection
1,
a
governmental
subdivision
29
may,
no
later
than
December
21,
2018,
adopt
minimum
energy
30
conservation
requirements
applicable
to
residential
31
construction
described
in
subsection
1
that
are
not
less
32
restrictive
than
the
minimum
energy
conservation
requirements
33
adopted
by
the
commissioner
and
approved
by
the
council.
34
If
adopted,
such
requirements
shall
apply
to
residential

construction
within
the
governmental
subdivision
in
lieu
of
the

energy
conservation
requirements
adopted
by
the
commissioner

and
approved
by
the
council.

2.
Section
103A.10,
subsection
5,
Code
2018,
is
amended
4
by
striking
the
subsection.

Sec.
3.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
6
importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
energy
conservation
requirements
11
contained
within
the
state
building
code
or
adopted
by
12
governmental
subdivisions.
13
Code
section
103A.8A
requires
new
single-family
or
14
two-family
residential
construction
commenced
on
or
after
15
July
1,
2008,
to
comply
with
energy
conservation
requirements
16
adopted
by
the
state
building
code
commissioner
and
approved
17
by
the
state
building
code
advisory
council.
The
energy
18
conservation
requirements
adopted
by
the
commissioner
and
19
approved
by
the
council
supersede
and
replace
any
minimum
20
energy
conservation
requirements
adopted
by
a
governmental
21
subdivision.

The
bill
amends
Code
section
103A.8A
to
provide
that
the
23
energy
conservation
requirements
shall
be
adopted
by
the
24
commissioner
and
approved
by
the
council
no
later
than
July
25
1,
2018,
and
shall
be
based
upon
the
2018
edition
of
the
26
international
energy
conservation
code.
In
approving
the
27
requirements,
the
council
may
make
modifications
by
a
majority
28
vote
of
the
members.
The
bill
provides
that
new
residential
29
construction
commenced
on
or
after
July
1,
2018,
shall
comply
30
with
the
energy
conservation
requirements,
extending
the
31
applicability
of
such
requirements
to
any
type
of
residential
32
building.

The
bill
removes
language
from
Code
section
103A.8A
that
34
provides
that
the
energy
conservation
requirements
adopted
by
35

the
commissioner
and
approved
by
the
council
are
to
supersede
1
any
minimum
requirements
adopted
by
a
governmental
subdivision.

The
bill
makes
conforming
changes
consistent
with
this

modification
in
Code
section
103A.10(5).

The
bill
provides
that
a
governmental
subdivision
may,
no
5
later
than
December
21,
2018,
adopt
minimum
energy
conservation
6
requirements
for
residential
construction
that
are
not
less
7
restrictive
than
the
minimum
energy
conservation
requirements
8
adopted
by
the
commissioner
and
approved
by
the
council.
If
9
a
governmental
subdivision
adopts
such
minimum
requirements,
10
then
applicable
residential
construction
must
comply
with
the
11
requirements
adopted
by
the
governmental
subdivision.
12
The
bill
takes
effect
upon
enactment.
