S.F. 2304 Section 1. NEW SECTION . 154G.1 Definitions. 1 As used in this chapter, unless the context otherwise 2 requires: 3 1. “Music therapist” means a person who holds one of the 4 following: 5 a. An active music therapist board-certified credential 6 granted by the certification board for music therapists. 7 b. A professional designation in good standing on the 8 national music therapy registry. 9 2. “Music therapy” means the clinical and evidence-based 10 use of music interventions to accomplish individualized goals 11 for people of all ages and ability levels within a therapeutic 12 relationship by a music therapist. 13 Sec. 2. NEW SECTION . 154G.2 Practice or use of title. 14 1. A person shall not profess to be a music therapist or 15 board-certified music therapist or use the initials “MT-BC” 16 or any other words, letters, abbreviations, or insignia 17 indicating or implying that the person is a music therapist 18 unless the person holds and maintains the music therapist 19 board-certified credential granted by the certification board 20 for music therapists or until January 20, 2020, is designated 21 as a registered music therapist, certified music therapist, or 22 advanced certified music therapist and is in good standing on 23 the national music therapy registry. 24 2. This chapter does not prohibit a person from using music 25 in the performance of the person’s profession or occupation if 26 incidental to the person’s profession or occupation and if the 27 person does not represent that the person is a music therapist. 28 3. A person who violates this section is guilty of a simple 29 misdemeanor. 30 EXPLANATION 31 The inclusion of this explanation does not constitute agreement with 32 the explanation’s substance by the members of the general assembly. 33 This bill requires any person claiming to be a music 34 therapist to hold a music therapist board-certified credential 35 -1- LSB 5721SS (7) 87 ss/rh 1/ 2
S.F. 2304 granted by the certification board for music therapists or 1 until January 20, 2020, is designated as a registered music 2 therapist, or advanced certified music therapist and is in good 3 standing on the national music therapy registry. A person who 4 violates this bill is guilty of a simple misdemeanor.
