1.
MEDICAID
LONG-TERM
SERVICES
AND
SUPPORTS
1
POPULATION
MEMBERS
——
PROVISION
OF
CONFLICT-FREE
SERVICES.
The
2
department
of
human
services
shall
adopt
rules
pursuant
to
3
chapter
17A
and
shall
amend
existing
Medicaid
managed
care
4
contracts
to
ensure
that
services
are
provided
under
the
5
Medicaid
program
to
members
of
the
long-term
services
and
6
supports
population
in
a
conflict-free
manner.
Specifically,
7
case
management
services
shall
be
provided
by
independent
8
providers,
supports
intensity
scale
(SIS)
assessments
shall
be
9
performed
by
independent
assessors,
and
neither
case
management
10
services
nor
SIS
assessments
shall
be
provided
or
performed
11
through
the
use
of
internal
resources
or
contracted
resources
12
of
a
Medicaid
managed
care
organization
under
contract
with
the
13
state.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
15
importance,
takes
effect
upon
enactment.

EXPLANATION
17
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
provision
of
conflict-free
services
20
to
Medicaid
long-term
services
and
supports
members.
The
21
bill
requires
the
department
of
human
services
(DHS)
to
adopt
22
administrative
rules
and
amend
existing
Medicaid
managed
care
23
contracts
to
ensure
that
services
are
provided
under
the
24
Medicaid
program
to
members
of
the
long-term
services
and
25
supports
population
in
a
conflict-free
manner.
Specifically,
26
case
management
services
shall
be
provided
by
independent
27
providers,
supports
intensity
scale
(SIS)
assessments
shall
be
28
performed
by
independent
assessors,
and
neither
case
management
29
services
nor
SIS
assessments
shall
be
provided
or
performed
30
through
the
use
of
internal
resources
or
contracted
resources
31
of
a
Medicaid
managed
care
organization
under
contract
with
the
32
state.

The
bill
takes
effect
upon
enactment.
