S.F. 2071 Section 1. Section 103.22, subsection 7, Code 2018, is 1 amended to read as follows: 2 7. Prohibit an owner of real property from performing 3 work on the owner’s principal residence real property , if 4 such residence property is an existing dwelling rather than 5 new construction and is not an apartment that is attached to 6 any other apartment or building, as those terms are defined 7 in section 499B.2 , and is not larger than a single-family 8 dwelling, or require such owner to be licensed under this 9 chapter . In order to qualify for inapplicability pursuant to 10 this subsection , a residence shall qualify for the homestead 11 tax exemption. 12 Sec. 2. Section 105.11, subsection 3, Code 2018, is amended 13 to read as follows: 14 3. Prohibit an owner of real property from performing 15 work on the owner’s principal residence real property , if 16 such residence property is an existing dwelling rather than 17 new construction and is not larger than a single-family 18 dwelling, or farm property, excluding commercial or industrial 19 installations or installations in public use buildings or 20 facilities, or require such owner to be licensed under this 21 chapter . In order to qualify for inapplicability pursuant to 22 this subsection , a residence shall qualify for the homestead 23 tax exemption. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to property owners’ rights with respect to 28 certain work performed on an owner’s real property. 29 Current law exempts a property owner from the electrician 30 and electrical contractor licensure requirements of Code 31 chapter 103 for performing work concerning electrical 32 installations on the owner’s principal residence, under 33 specified circumstances. Current law also exempts a property 34 owner from the plumber, mechanical professional, and contractor 35 -1- LSB 5669XS (1) 87 gh/rn 1/ 2
S.F. 2071 licensing requirements of Code chapter 105 for performing work 1 concerning plumbing and mechanical systems on the owner’s 2 principal residence, under specified circumstances. In either 3 case, a residence must qualify for the homestead tax exemption 4 pursuant to Code chapter 425 for a property owner to undertake 5 such work without having to obtain licensure. 6 The bill replaces “principal residence” with “real property” 7 for both exemptions, allowing a real property owner to perform 8 such work on the owner’s real property, if the property meets 9 specified circumstances, without having to obtain licensure 10 under Code chapter 103 or 105. The bill also removes the 11 requirement for a residence to qualify for the homestead tax 12 exemption to have either exemption be applicable to a real 13 property owner. 14 -2- LSB 5669XS (1) 87 gh/rn 2/ 2
