S.F. 188 Section 1. Section 724.22, subsection 5, Code 2017, is 1 amended to read as follows: 2 5. A parent , or guardian , or spouse who is twenty-one years 3 of age or older, of a person fourteen years of age but less than 4 below the age of twenty-one may allow the person to possess a 5 pistol or revolver or the ammunition therefor for any lawful 6 purpose while under the direct supervision of the parent , or 7 guardian , or spouse who is twenty-one years of age or older, or 8 while the person receives instruction in the proper use thereof 9 from an instructor twenty-one years of age or older, with the 10 consent of such parent, guardian , or spouse. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 Under this bill, a parent or guardian or spouse who is 21 15 years of age or older, or another with the consent of the 16 minor’s parent or guardian or spouse who is 21 years of age 17 or older, may allow a person below 21 years of age to possess 18 a pistol or revolver or the ammunition therefor, while under 19 supervision, which then may be lawfully used. 20 Current law allows a parent, guardian, or spouse who is 21 21 years of age or older, of a person at least 14 years of age 22 but below 21 years of age, to possess a pistol or revolver or 23 the ammunition therefor, while under supervision, which may 24 lawfully be used. However, current law prohibits a parent 25 or guardian or spouse who is 21 years of age or older from 26 allowing a person under 14 years of age from possessing a 27 pistol or revolver or the ammunition. 28 Except for the circumstances under Code section 724.22(4) 29 (security personnel) or this bill, a person who sells, loans, 30 gives, or makes available a pistol or revolver or ammunition 31 for a pistol or revolver to a person below the age of 21 commits 32 a serious misdemeanor for a first offense and a class “D” 33 felony for second and subsequent offenses. 34 The bill does not address a rifle or shotgun but current law 35 -1- LSB 1852XS (3) 87 jm/rh/rj 1/ 2
S.F. 188 does allow a parent, guardian, or spouse who is 18 years of age 1 or older, or another with the express consent of the minor’s 2 parent or guardian or spouse who is 18 years of age or older may 3 allow a minor to possess a rifle or shotgun or the ammunition 4 therefor which may be lawfully used. A serious misdemeanor is 5 punishable by confinement for no more than one year and a fine 6 of at least $315 but not more than $1,875.
