GOALS AND ACCOUNTABILITY —— ECONOMIC DEVELOPMENT. 21 1. For the fiscal year beginning July 1, 2017, the goals 22 for the economic development authority shall be to expand and 23 stimulate the state economy, increase the wealth of Iowans, and 24 increase the population of the state. 25 2. To achieve the goals in subsection 1, the economic 26 development authority shall do all of the following for the 27 fiscal year beginning July 1, 2017: 28 a. Concentrate its efforts on programs and activities that 29 result in commercially viable products and services. 30 b. Adopt practices and services consistent with free 31 market, private sector philosophies. 32 c. Ensure economic growth and development throughout the 33 state. 34 d. Work with businesses and communities to continually 35 -2- LSB 1048JB (2) 87 aw/tm 2/ 42
S.F. _____ H.F. _____ improve the economic development climate along with the 1 economic well-being and quality of life for Iowans. 2 e. Coordinate with other state agencies to ensure that they 3 are attentive to the needs of an entrepreneurial culture. 4 f. Establish a strong and aggressive marketing image to 5 showcase Iowa’s workforce, existing industry, and potential. 6 A priority shall be placed on recruiting new businesses, 7 business expansion, and retaining existing Iowa businesses. 8 Emphasis shall be placed on entrepreneurial development through 9 helping entrepreneurs secure capital, and developing networks 10 and a business climate conducive to entrepreneurs and small 11 businesses. 12 g. Encourage the development of communities and quality of 13 life to foster economic growth. 14 h. Prepare communities for future growth and development 15 through development, expansion, and modernization of 16 infrastructure. 17 i. Develop public-private partnerships with Iowa businesses 18 in the tourism industry, Iowa tour groups, Iowa tourism 19 organizations, and political subdivisions in this state to 20 assist in the development of advertising efforts. 21 j. Develop, to the fullest extent possible, cooperative 22 efforts for advertising with contributions from other sources. 23 Sec. 3. ECONOMIC DEVELOPMENT AUTHORITY. 24 1. APPROPRIATION 25 a. S.F. _____ H.F. _____ division, a business development division, a community 1 development division, a small business development division, 2 and other divisions the authority may organize. 3 (2) The full-time equivalent positions authorized under 4 this section are funded, in whole or in part, by the moneys 5 appropriated under this subsection or by other moneys received 6 by the authority, including certain federal moneys. 7 (3) For business development operations and programs, 8 international trade, export assistance, workforce recruitment, 9 and the partner state program. 10 (4) For transfer to a fund created pursuant to section 11 15.313 for purposes of financing strategic infrastructure 12 projects. 13 (5) For community economic development programs, tourism 14 operations, community assistance, plans for Iowa green corps 15 and summer youth programs, the mainstreet and rural mainstreet 16 programs, the school-to-career program, the community 17 development block grant, and housing and shelter-related 18 programs. 19 (6) For achieving the goals and accountability, and 20 fulfilling the requirements and duties required under this Act. 21 c. Notwithstanding section 8.33, moneys appropriated in 22 this subsection that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available for expenditure for the purposes designated in this 25 subsection until the close of the succeeding fiscal year. 26 2. FINANCIAL ASSISTANCE RESTRICTIONS 27 a. A business creating jobs through moneys appropriated in 28 subsection 1 shall be subject to contract provisions requiring 29 new and retained jobs to be filled by individuals who are 30 citizens of the United States who reside within the United 31 States or any person authorized to work in the United States 32 pursuant to federal law, including legal resident aliens in the 33 United States. 34 b. Any vendor who receives moneys appropriated in 35 -4- LSB 1048JB (2) 87 aw/tm 4/ 42
S.F. _____ H.F. _____ subsection 1 shall adhere to such contract provisions and 1 provide periodic assurances as the state shall require that the 2 jobs are filled solely by citizens of the United States who 3 reside within the United States or any person authorized to 4 work in the United States pursuant to federal law, including 5 legal resident aliens in the United States. 6 c. A business that receives financial assistance from 7 the authority from moneys appropriated in subsection 1 shall 8 only employ individuals legally authorized to work in this 9 state. In addition to all other applicable penalties provided 10 by current law, all or a portion of the assistance received 11 by a business which is found to knowingly employ individuals 12 not legally authorized to work in this state is subject to 13 recapture by the authority. 14 3. USES OF APPROPRIATIONS 15 a. From the moneys appropriated in subsection 1, the 16 authority may provide financial assistance in the form of a 17 grant to a community economic development entity for conducting 18 a local workforce recruitment effort designed to recruit former 19 citizens of the state and former students at colleges and 20 universities in the state to meet the needs of local employers. 21 b. From the moneys appropriated in subsection 1, the 22 authority may provide financial assistance to early stage 23 industry companies being established by women entrepreneurs. 24 c. From the moneys appropriated in subsection 1, the 25 authority may provide financial assistance in the form of 26 grants, loans, or forgivable loans for advanced research and 27 commercialization projects involving value-added agriculture, 28 advanced technology, or biotechnology. 29 d. The authority shall not use any moneys appropriated in 30 subsection 1 for purposes of providing financial assistance for 31 the Iowa green streets pilot project or for any other program 32 or project that involves the installation of geothermal systems 33 for melting snow and ice from streets or sidewalks. 34 4. FTEs 7.00 17 Of the moneys appropriated in this subsection, the 18 authority shall allocate $75,000 for purposes of the Iowa state 19 commission grant program and $93,201 for purposes of the Iowa’s 20 promise and Iowa mentoring partnership programs. 21 Notwithstanding section 8.33 , moneys appropriated in this 22 subsection that remain unencumbered or unobligated at the close 23 of the fiscal year shall not revert but shall remain available 24 for expenditure for the purposes designated until the close of 25 the succeeding fiscal year. 26 6. COUNCILS OF GOVERNMENTS —— ASSISTANCE 27 There is appropriated from the general fund of the state 28 to the economic development authority for the fiscal year 29 beginning July 1, 2017, and ending June 30, 2018, the following 30 amount to be used for the purposes of providing financial 31 assistance to Iowa’s councils of governments: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 175,000 33 7. There is appropriated from the Iowa skilled worker and 1 job creation fund created in section 8.75 to the Iowa economic 2 development authority for the fiscal year beginning July 1, 3 2017, and ending June 30, 2018, the following amount, or so 4 much thereof as is necessary, for the purposes designated: 5 For the funding of internships for students studying in the 6 fields of science, technology, engineering, and mathematics 7 with eligible Iowa employers as provided in section 15.411, 8 subsection 3, paragraph “c”: 9 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 10 b. No more than 3 percent of the moneys appropriated in this 11 subsection may be used by the authority for costs associated 12 with administration of the internship program. 13 c. Notwithstanding section 8.33, moneys appropriated in 14 this subsection which remain unencumbered or unobligated at 15 the end of the fiscal year shall not revert but shall remain 16 available for expenditure for the purposes designated in 17 subsequent fiscal years. 18 Sec. 4. LIMITATIONS OF STANDING APPROPRIATIONS —— FY 19 2017-2018. Notwithstanding the standing appropriations 20 in the following designated sections for the fiscal year 21 beginning July 1, 2017, and ending June 30, 2018, the amounts 22 appropriated from the general fund of the state pursuant to 23 these sections for the following purposes shall not exceed the 24 following amounts: 25 1. For operational support grants and community cultural 26 grants under section 99F.11, subsection 3, paragraph “d”, 27 subparagraph (1): 28 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 416,702 29 2. INSURANCE ECONOMIC DEVELOPMENT. From the moneys 33 collected by the division of insurance in excess of the 34 anticipated gross revenues under section 505.7, subsection 35 -7- LSB 1048JB (2) 87 aw/tm 7/ 42
S.F. _____ H.F. _____ 3 , during the fiscal year beginning July 1, 2017, $100,000 1 shall be transferred to the economic development authority for 2 insurance economic development and international insurance 3 economic development. 4 Sec. 6. IOWA FINANCE AUTHORITY. 5 1. There is appropriated from the general fund of the state 6 to the Iowa finance authority for the fiscal year beginning 7 July 1, 2017, and ending June 30, 2018, the following amount, 8 or so much thereof as is necessary, to be used to provide 9 reimbursement for rent expenses to eligible persons under the 10 rent subsidy program: 11 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 658,000 12 2. Participation in the rent subsidy program shall be 13 limited to only those persons who meet the requirements for the 14 nursing facility level of care for home and community-based 15 services waiver services as in effect on July 1, 2017, 16 and to those individuals who are eligible for the federal 17 money follows the person grant program under the medical 18 assistance program. If the Iowa finance authority utilizes 19 a waiting list, the authority shall give priority to a 20 person participating in the state’s money follows the person 21 partnership for community integration project who has been 22 assigned to work with a transition specialist. Of the moneys 23 appropriated in this section, not more than $35,000 may be used 24 for administrative costs. 25 Sec. 7. IOWA FINANCE AUTHORITY AUDIT. The auditor of state 26 is requested to review the audit of the Iowa finance authority 27 performed by the auditor hired by the authority. 28 Sec. 8. PUBLIC EMPLOYMENT RELATIONS BOARD. 29 1. There is appropriated from the general fund of the state 30 to the public employment relations board for the fiscal year 31 beginning July 1, 2017, and ending June 30, 2018, the following 32 amount, or so much thereof as is necessary, for the purposes 33 designated: 34 For salaries, support, maintenance, and miscellaneous 35 -8- LSB 1048JB (2) 87 aw/tm 8/ 42

The moneys generated by the filing 1 fee allowed under this subsection are appropriated to the 2 department of workforce development to be used for purposes of 3 administering the division of workers’ compensation. 4 3. WORKFORCE DEVELOPMENT OPERATIONS 5 a. S.F. _____ H.F. _____ department of workforce development shall require a unique 1 identification login for all users of workforce development 2 centers operated through electronic means. 3 Sec. 14. UNEMPLOYMENT COMPENSATION PROGRAM. Notwithstanding 4 section 96.9, subsection 4 , paragraph “a”, moneys credited to 5 the state by the secretary of the treasury of the United 6 States pursuant to section 903 of the Social Security 7 Act are appropriated to the department of workforce 8 development and shall be used by the department for the 9 administration of the unemployment compensation program only. 10 This appropriation shall not apply to any fiscal year 11 beginning after December 31, 2017. 12 Sec. 15. UNEMPLOYMENT INSURANCE SYSTEMS MODERNIZATION 13 —— USE OF FUNDS AUTHORIZATION. Incentive payment moneys 14 transferred by the secretary of labor of the United States to 15 the state as a special transfer pursuant to section 2003 of 16 the Assistance for Unemployed Workers and Struggling Families 17 Act, enacted pursuant to Pub. L. For the fiscal year beginning July 1, 2018, the goals 2 for the economic development authority shall be to expand and 3 stimulate the state economy, increase the wealth of Iowans, and 4 increase the population of the state. 5 2. To achieve the goals in subsection 1, the economic 6 development authority shall do all of the following for the 7 fiscal year beginning July 1, 2018: 8 a. Concentrate its efforts on programs and activities that 9 result in commercially viable products and services. 10 b. Adopt practices and services consistent with free 11 market, private sector philosophies. 12 c. Ensure economic growth and development throughout the 13 state. 14 d. Work with businesses and communities to continually 15 improve the economic development climate along with the 16 economic well-being and quality of life for Iowans. 17 e. Coordinate with other state agencies to ensure that they 18 are attentive to the needs of an entrepreneurial culture. 19 f. Establish a strong and aggressive marketing image to 20 showcase Iowa’s workforce, existing industry, and potential. 21 A priority shall be placed on recruiting new businesses, 22 business expansion, and retaining existing Iowa businesses. 23 Emphasis shall be placed on entrepreneurial development through 24 helping entrepreneurs secure capital, and developing networks 25 and a business climate conducive to entrepreneurs and small 26 businesses. 27 g. Encourage the development of communities and quality of 28 life to foster economic growth. 29 h. Prepare communities for future growth and development 30 through development, expansion, and modernization of 31 infrastructure. 32 i. Develop public-private partnerships with Iowa 33 businesses in the tourism industry, Iowa tour groups, Iowa 34 tourism organizations, and political subdivisions in this state 35 -19- LSB 1048JB (2) 87 aw/tm 19/ 42

Notwithstanding section 8.33, moneys appropriated in 2 this subsection that remain unencumbered or unobligated at the 3 close of the fiscal year shall not revert but shall remain 4 available for expenditure for the purposes designated in this 5 subsection until the close of the succeeding fiscal year. 6 2. FINANCIAL ASSISTANCE RESTRICTIONS 7 a. A business creating jobs through moneys appropriated in 8 subsection 1 shall be subject to contract provisions requiring 9 new and retained jobs to be filled by individuals who are 10 citizens of the United States who reside within the United 11 States or any person authorized to work in the United States 12 pursuant to federal law, including legal resident aliens in the 13 United States. 14 b. Any vendor who receives moneys appropriated in 15 subsection 1 shall adhere to such contract provisions and 16 provide periodic assurances as the state shall require that the 17 jobs are filled solely by citizens of the United States who 18 reside within the United States or any person authorized to 19 work in the United States pursuant to federal law, including 20 legal resident aliens in the United States. 21 c. A business that receives financial assistance from 22 the authority from moneys appropriated in subsection 1 shall 23 only employ individuals legally authorized to work in this 24 state. In addition to all other applicable penalties provided 25 by current law, all or a portion of the assistance received 26 by a business which is found to knowingly employ individuals 27 not legally authorized to work in this state is subject to 28 recapture by the authority. 29 3. USES OF APPROPRIATIONS 30 a. From the moneys appropriated in subsection 1, the 31 authority may provide financial assistance in the form of a 32 grant to a community economic development entity for conducting 33 a local workforce recruitment effort designed to recruit former 34 citizens of the state and former students at colleges and 35 -21- LSB 1048JB (2) 87 aw/tm 21/ 42
S.F. _____ H.F. _____ universities in the state to meet the needs of local employers. 1 b. From the moneys appropriated in subsection 1, the 2 authority may provide financial assistance to early stage 3 industry companies being established by women entrepreneurs. 4 c. From the moneys appropriated in subsection 1, the 5 authority may provide financial assistance in the form of 6 grants, loans, or forgivable loans for advanced research and 7 commercialization projects involving value-added agriculture, 8 advanced technology, or biotechnology. 9 d. The authority shall not use any moneys appropriated in 10 subsection 1 for purposes of providing financial assistance for 11 the Iowa green streets pilot project or for any other program 12 or project that involves the installation of geothermal systems 13 for melting snow and ice from streets or sidewalks. 14 4. WORLD FOOD PRIZE 15 There is appropriated from the general fund of the state 16 to the economic development authority for the fiscal year 17 beginning July 1, 2018, and ending June 30, 2019, the following 18 amount for the world food prize and in lieu of the standing 19 appropriation in section 15.368 : 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 21 5. Participation in the rent subsidy program shall be 28 limited to only those persons who meet the requirements for the 29 nursing facility level of care for home and community-based 30 services waiver services as in effect on July 1, 2018, 31 and to those individuals who are eligible for the federal 32 money follows the person grant program under the medical 33 assistance program. NEW SECTION . 20.33 Retention of costs and fees. 4 1. All moneys paid in advance by the board and subsequently 5 taxed as a cost to a party or parties pursuant to section 6 20.6, subsection 6, and section 20.11, subsection 3, shall, 7 when reimbursed by the party or parties taxed under those 8 sections, be retained by the board as repayment receipts and 9 used exclusively to offset the cost of the certified shorthand 10 reporter reporting the proceeding and of any transcript 11 requested by the board. 12 2. All fees established and collected by the board 13 pursuant to section 20.6, subsection 7, shall be retained by 14 the board as repayment receipts and used exclusively for the 15 purpose of covering the cost of elections required pursuant to 16 section 20.15, including payment for the services of any vendor 17 retained by the board to conduct or assist in the conduct of 18 such an election. 19 DIVISION IV 20 IOWA ENERGY CENTER 21 Sec. 34. Section 15.108, subsection 9, Code 2017, is amended 22 by adding the following new paragraph: 23 NEW PARAGRAPH . g. Administer the Iowa energy center 24 established in section 15.120. This paragraph “g” is repealed 25 July 1, 2022. 26 Sec. 35. NEW SECTION . 15.120 The Iowa energy center. 27 1. The Iowa energy center is established within the 28 authority with the following purposes: 29 a. To expand workforce and career opportunities for workers 30 in the energy sector to ensure that the state is able to 31 attract and train professionals to meet the state’s future 32 energy needs. 33 b. To support technology-based development by encouraging 34 public-private partnerships and innovative manufacturers to 35 -33- LSB 1048JB (2) 87 aw/tm 33/ 42
S.F. _____ H.F. _____ develop and bring to market new energy technologies. 1 c. To support rural and underserved areas and vulnerable 2 populations by creating opportunities for greater access to 3 energy efficiency expertise, training, programs, and cyber 4 security preparedness for small utilities. 5 d. To support the expansion of natural gas infrastructure to 6 rural and underserved areas of the state where the absence is a 7 limiting factor to economic development. 8 e. To promote and fund research, development, and 9 commercialization of biomass technology to benefit the state 10 economically and environmentally by further realizing the 11 value-added attributes of biomass in the development of 12 bioenergy, biofuels, and biochemicals. 13 f. To encourage growth of the alternative fuel vehicle 14 market, particularly for electric vehicles, and the 15 infrastructure necessary to support the market. 16 g. To support efforts to modernize the electric grid 17 infrastructure of the state to support increased capacity and 18 new technologies. 19 2. a. A governing board is established consisting of the 20 following members appointed by the governor: 21 (1) One member representing Iowa state university of 22 science and technology, in consultation with the president of 23 that university. 24 (2) One member representing the university of Iowa, in 25 consultation with the president of that university. 26 (3) One member representing the university of northern 27 Iowa, in consultation with the president of that university. 28 (4) One member representing private colleges and 29 universities within the state, in consultation with the Iowa 30 association of independent colleges and universities. 31 (5) One member representing community colleges, in 32 consultation with the Iowa association of community college 33 trustees. 34 (6) One member representing the economic development 35 -34- LSB 1048JB (2) 87 aw/tm 34/ 42
S.F. _____ H.F. _____ authority, in consultation with the director of the economic 1 development authority. 2 (7) One member representing the state department of 3 transportation, in consultation with the director of the 4 department of transportation. 5 (8) One member representing the office of consumer 6 advocate, in consultation with the consumer advocate. 7 (9) One member representing the utilities board, in 8 consultation with the chair of the utilities board. 9 (10) One member representing rural electric cooperatives, 10 in consultation with the Iowa association of electric 11 cooperatives. 12 (11) One member representing municipal utilities, in 13 consultation with the Iowa association of municipal utilities. 14 (12) Two members representing investor-owned utilities, 15 one representing gas utilities, and one representing electric 16 utilities, in consultation with the Iowa utility association. 17 b. The terms of the members shall begin and end as provided 18 in section 69.19 and any vacancy shall be filled by the 19 governor as provided for in this subsection. The terms shall 20 be for four years and shall be staggered as determined by the 21 director of the economic development authority. 22 c. The board shall oversee, approve, and provide direction 23 concerning the programs established by the center and shall 24 coordinate with the center and the director of the authority 25 for the implementation of such programs. In overseeing the 26 center and its programs, the board shall ensure that all 27 ratepayer moneys remitted by the utilities board pursuant to 28 section 476.10A are expended on programs and projects designed 29 to provide benefits to gas and electric utility ratepayers. 30 d. The deliberations or meetings of the governing board 31 shall be conducted in accordance with chapter 21. 32 e. The board, in consultation with center staff, shall adopt 33 rules for the administration of the center and its programs 34 pursuant to chapter 17A. 35 -35- LSB 1048JB (2) 87 aw/tm 35/ 42
S.F. _____ H.F. _____ 3. a. The center shall employ necessary support staff. 1 The center staff shall be employees of the authority. Moneys 2 appropriated to the center shall be used to sponsor grants and 3 projects submitted on a competitive basis by Iowa businesses, 4 colleges and universities, and private nonprofit agencies and 5 foundations, and for the salaries and benefits of the employees 6 of the center. The center may also solicit additional grants 7 and funding from public and private nonprofit agencies and 8 foundations. 9 b. The center shall prepare an annual report in coordination 10 with the authority. The center shall submit the report to the 11 general assembly and the legislative services agency by January 12 15 of each year. 13 4. The governing board shall oversee the center in the 14 development of a budget, on the policies and procedures of 15 the center, in the funding of grant proposals, and in matters 16 relating to program planning and review. The center’s annual 17 budget shall be approved by the board. 18 5. This section is repealed July 1, 2022. 19 Sec. 36. Section 476.1A, subsection 1, paragraph e, Code 20 2017, is amended to read as follows: 21 e. Assessment of fees for the support of the Iowa energy 22 center created in section 266.39C 15.120 and the center for 23 global and regional environmental research established by the 24 state board of regents. This paragraph “e” is repealed July 1, 25 2022. 26 Sec. 37. Section 476.1B, subsection 1, paragraph k, Code 27 2017, is amended to read as follows: 28 k. Assessment of fees for the support of the Iowa energy 29 center created in section 266.39C 15.120 and the center for 30 global and regional environmental research created by the state 31 board of regents. This paragraph “k” is repealed July 1, 2022. 32 Sec. 38. Section 476.1C, subsection 1, paragraph b, Code 33 2017, is amended to read as follows: 34 b. Shall be subject to the assessment of fees for the 35 -36- LSB 1048JB (2) 87 aw/tm 36/ 42
S.F. _____ H.F. _____ support of the Iowa energy center created in section 266.39C 1 15.120 and the center for global and regional environmental 2 research created by the state board of regents and shall file 3 energy efficiency plans and energy efficiency results with 4 the board. The energy efficiency plans as a whole shall be 5 cost-effective. The board may waive all or part of the energy 6 efficiency filing requirements if the gas utility demonstrates 7 superior results with existing energy efficiency efforts . This 8 paragraph “b” is repealed July 1, 2022. 9 Sec. 39. Section 476.1C, subsection 1, Code 2017, is amended 10 by adding the following new paragraph: 11 NEW PARAGRAPH . 0c. Shall file energy efficiency plans 12 and energy efficiency results with the board. The energy 13 efficiency plans as a whole shall be cost-effective. The 14 board may waive all or part of the energy efficiency filing 15 requirements if the gas utility demonstrates superior results 16 with existing energy efficiency efforts. 17 Sec. 40. Section 476.10A, subsection 1, paragraph c, 18 subparagraph (1), Code 2017, is amended to read as follows: 19 (1) Eighty-five percent of the remittances collected 20 pursuant to this section is appropriated to the Iowa energy 21 center created in section 266.39C 15.120 . 22 Sec. 41. Section 476.10A, Code 2017, is amended by adding 23 the following new subsection: 24 NEW SUBSECTION . 4. This section is repealed July 1, 2022. 25 Sec. 42. Section 476.46, subsection 1, Code 2017, is amended 26 to read as follows: 27 1. The Iowa energy center created under section 266.39C 28 15.120 shall establish and administer an alternate energy 29 revolving loan program to encourage the development of 30 alternate energy production facilities and small hydro 31 facilities within the state. 32 Sec. 43. Civil penalties collected pursuant to this section 6 shall be forwarded by the executive secretary of the board 7 to the treasurer of state to be credited to the Iowa energy 8 center created in section 266.39C the general fund of the state 9 and appropriated to the division of community action agencies 10 of the department of human rights for purposes of the low 11 income home energy assistance program and the weatherization 12 assistance program . 13 Sec. 45. Section 479.31, subsection 1, Code 2017, is amended 14 to read as follows: 15 1. A person who violates this chapter or any rule or order 16 issued pursuant to this chapter shall be subject to a civil 17 penalty levied by the board not to exceed one hundred thousand 18 dollars for each violation. Each day that the violation 19 continues shall constitute a separate offense. However, the 20 maximum civil penalty shall not exceed one million dollars 21 for any related series of violations. Civil penalties 22 collected pursuant to this section shall be credited to and 23 are appropriated for the Iowa energy center created in section 24 266.39C forwarded by the executive secretary of the board to 25 the treasurer of state to be credited to the general fund 26 of the state and appropriated to the division of community 27 action agencies of the department of human rights for purposes 28 of the low income home energy assistance program and the 29 weatherization assistance program . 30 Sec. 46. Section 479B.21, unnumbered paragraph 1, Code 31 2017, is amended to read as follows: 32 A person who violates this chapter or any rule or order 33 issued pursuant to this chapter shall be subject to a civil 34 penalty levied by the board in an amount not to exceed one 35 -38- LSB 1048JB (2) 87 aw/tm 38/ 42

Each day that the 1 violation continues shall constitute a separate offense. 2 However, the maximum civil penalty shall not exceed two hundred 3 thousand dollars for any related series of violations. Civil 4 penalties collected pursuant to this section shall be credited 5 to and are appropriated for the use of the Iowa energy center 6 created in section 266.39C forwarded by the executive secretary 7 of the board to the treasurer of state to be credited to the 8 general fund of the state and appropriated to the division of 9 community action agencies of the department of human rights for 10 purposes of the low income home energy assistance program and 11 the weatherization assistance program . 12 Sec. 47. REPEAL. Section 266.39C, Code 2017, is repealed. 13 Sec. 48. TRANSITION PROVISIONS. 14 1. Any moneys remaining in any account or fund under the 15 control of Iowa state university of science and technology 16 on the effective date of this division of this Act that 17 were appropriated to the Iowa energy center, including 18 moneys appropriated pursuant to section 476.10A, section 19 476.46, section 478.29, section 479.31, or section 479B.21, 20 shall, as directed by the economic development authority, be 21 transferred to a comparable fund or account under the control 22 of the economic development authority for such purposes. 23 Notwithstanding section 8.33, the moneys transferred in 24 accordance with this subsection shall not revert to the account 25 or fund from which appropriated or transferred and shall be 26 retained for the designated purposes. 27 2. Grants, loans, scholarships, and other financial 28 commitments pledged or awarded by the Iowa energy center or 29 by Iowa state university of science and technology on behalf 30 of the Iowa energy center prior to the effective date of this 31 division of this Act shall continue as provided by the terms of 32 the grants, loans, scholarships, or other financial commitments 33 and shall be administered by the Iowa economic development 34 authority. Moneys received from any future repayments or 35 -39- LSB 1048JB (2) 87 aw/tm 39/ 42
S.F. _____ H.F. _____ recaptures, or other moneys derived from these commitments, 1 after the effective date of this division of this Act shall be 2 credited to a fund or account under the control of the economic 3 development authority as directed by the economic development 4 authority. Contracts for the procurement of goods and 5 services, leases, and facility use agreements entered into by 6 the Iowa energy center or by Iowa state university of science 7 and technology on behalf of the Iowa energy center shall not be 8 transferred to the economic development authority and shall be 9 assumed by Iowa state university of science and technology. 10 3. Title to real and personal property procured by the 11 Iowa energy center or by the Iowa state university of science 12 and technology on behalf of the Iowa energy center prior to 13 the effective date of this division of this Act shall remain 14 with or be assumed by Iowa state university of science and 15 technology, except that ownership of real or personal property 16 pledged as collateral on existing loans shall be transferred to 17 the economic development authority. 18 4. Staff of the Iowa energy center employed by Iowa state 19 university of science and technology shall not become employees 20 of the economic development authority upon the effective date 21 of this division of this Act. 22 5. The economic development authority and the Iowa state 23 university of science and technology shall collaborate their 24 efforts in transitioning the Iowa energy center to the economic 25 development authority. 26 Sec. 49. EFFECTIVE DATE. This division of this Act takes 27 effect October 1, 2017. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill makes appropriations and transfers for FY 32 2017-2018 and FY 2018-2019 from the general fund of the state 33 and other funds to the department of cultural affairs, the 34 economic development authority, the Iowa finance authority, the 35 -40- LSB 1048JB (2) 87 aw/tm 40/ 42
S.F. _____ H.F. _____ public employment relations board, the department of workforce 1 development, the board of regents, the state university 2 of Iowa, the university of northern Iowa, and Iowa state 3 university of science and technology. The bill is organized 4 by divisions. 5 The bill appropriates moneys for FY 2017-2018 and FY 6 2018-2019 from the special employment security contingency fund 7 to the department of workforce development for field offices. 8 The bill appropriates interest earned on the unemployment 9 compensation reserve fund for FY 2017-2018 and FY 2018-2019 to 10 the department of workforce development for the operation of 11 field offices. 12 The bill appropriates moneys for FY 2017-2018 from the 13 unemployment compensation fund to the department of workforce 14 development for modernization of systems and for other 15 programs. 16 The bill appropriates moneys for FY 2017-2018 and FY 17 2018-2019 from the Iowa skilled worker and job creation fund to 18 the economic development authority and the board of regents and 19 certain regents institutions. 20 The bill limits standing appropriations, established in 21 Code, for the world food prize, certain operational support 22 grants, community cultural grants, and regional tourism 23 marketing for FY 2017-2018 and FY 2018-2019. 24 The bill also provides for the retention of certain costs 25 and fees by the public employment relations board. 26 The bill transfers the administration of the Iowa energy 27 center from the Iowa state university of science and technology 28 (Iowa state) to the economic development authority (EDA). The 29 bill repeals Code section 266.39C and establishes new Code 30 section 15.120, which places the center within the EDA. The 31 bill provides that the center has the following specified 32 purposes: to expand workforce and career opportunities for 33 workers in the energy sector; to support technology-based 34 development with public-private partnerships and innovative 35 -41- LSB 1048JB (2) 87 aw/tm 41/ 42
S.F. _____ H.F. _____ manufacturers; to support rural and underserved areas and 1 vulnerable populations by providing resources for energy 2 efficiency and cyber security-related resources; to support 3 the expansion of natural gas infrastructure to rural and 4 underserved areas of the state; to promote the research, 5 development, and commercialization of biomass technology; to 6 encourage growth of the alternative fuel vehicle market and 7 infrastructure; and to support efforts to modernize the state’s 8 electric grid infrastructure. 9 The bill establishes a governing board consisting of the 10 same number and background of members in the advisory council 11 established in current Code section 266.39C, but all to be 12 appointed by the governor in consultation with specified 13 persons. The board must oversee, approve, and provide 14 direction for the center’s programs and shall ensure that all 15 ratepayer moneys remitted by the utilities board pursuant to 16 Code section 476.10A are used on programs designed to provide 17 benefits to gas and electric utility ratepayers. The board 18 must also oversee the center in the development of a budget 19 and other matters and approve the center’s annual budget. The 20 bill excludes provisions relating to the appointment of a 21 director as contained in current Code section 266.39C. The 22 bill requires the center to employ necessary support staff 23 and prepare an annual report in coordination with the EDA and 24 submit the report to the general assembly and the legislative 25 services agency. 26 The bill makes conforming changes throughout the Code by 27 replacing references to Code section 266.39C with Code section 28 15.120, and provides transition provisions. 29 The division of the bill related to the Iowa energy center 30 takes effect October 1, 2017.
