H.F. 2433 Section 1. Section 331.441, subsection 2, paragraph b, 1 subparagraph (5), unnumbered paragraph 1, Code 2018, is amended 2 to read as follows: 3 Public buildings, including the site or grounds of, and the 4 erection, equipment, remodeling, or reconstruction of, and 5 additions or extensions to the buildings, and including the 6 provision and maintenance of juvenile detention or shelter care 7 facilities, when the cost principal amount of the bonds does 8 not exceed the following limits: 9 Sec. 2. Section 331.441, subsection 2, paragraph c, 10 subparagraph (9), Code 2018, is amended to read as follows: 11 (9) Public buildings, including the site or grounds of, 12 the erection, equipment, remodeling, or reconstruction of, and 13 additions or extensions to the buildings, and including the 14 provision and maintenance of juvenile detention or shelter care 15 facilities, when the cost principal amount of the bonds exceeds 16 the limits stated in subsection 2 , paragraph “b” , subparagraph 17 (5). 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 If a county proposes to carry out a general county purpose 22 using funds from the issuance of general obligation bonds, 23 generally the issuance of such bonds must first be approved by 24 the registered voters of the county. Current law establishes 25 an exception by providing that a county, in lieu of calling 26 an election, may institute proceedings for the issuance of 27 bonds for a general county purpose by notice and publication 28 of the proposal to issue the bonds that includes a notice of 29 the right to petition for an election, subject to cost and city 30 population limitations. However, if at any time before the 31 date fixed for taking action for the issuance of the bonds, a 32 valid petition is filed with the county auditor asking that the 33 question of issuing the bonds be submitted to the registered 34 voters of the county, the board of supervisors shall either by 35 -1- LSB 5910HV (2) 87 md/jh 1/ 2
H.F. 2433 resolution declare the proposal to issue the bonds to have been 1 abandoned or shall direct the county commissioner of elections 2 to call a special election upon the question of issuing the 3 bonds. 4 This bill modifies the cost limitations for each of the 5 population categories in order to use the specified bond 6 issuance procedure by changing the amount limitations to be 7 calculated based on the principal amount of the bonds rather 8 than the cost of the project. 9 -2- LSB 5910HV (2) 87 md/jh 2/ 2
