H.F. 2290 Section 1. Section 148G.1, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 10A. “Sleep diagnostic testing facility” 3 means a building or place situated in a fixed location 4 or a mobile entity that is used to provide sleep-related 5 services and includes sleep-related disorder centers and 6 laboratories for sleep-related respiratory disorders, but 7 does not include a hospital licensed under chapter 135B that 8 provides sleep-related services for its patients, including 9 sleep-related services provided under arrangements made by 10 the hospital for its patients whereby the hospital exercises 11 professional responsibility over the arranged services. 12 Sec. 2. Section 148G.3, Code 2018, is amended to read as 13 follows: 14 148G.3 Location of services. 15 The practice of polysomnography shall take place only in a 16 facility that is accredited by a nationally recognized sleep 17 medicine laboratory or center accrediting agency, in a facility 18 operated by a hospital or a hospital licensed under chapter 19 135B , or in a patient’s home , with testing equipment provided 20 by a sleep diagnostic testing facility, hospital licensed 21 under chapter 135B, or mobile testing company with a physical 22 location in the state of Iowa, pursuant to rules adopted by 23 the board; provided, however, that the scoring of data and the 24 education of patients may take place in another setting. 25 Sec. 3. NEW SECTION . 148G.3A Supervision of sleep-related 26 services in a patient’s home. 27 Sleep-related services provided in a patient’s home shall 28 be conducted under the general supervision of a physician 29 or qualified health care professional prescriber and the 30 results thereof shall be interpreted by a physician. Patients 31 shall be educated on the proper use of testing equipment 32 by a respiratory care practitioner, respiratory care and 33 polysomnography practitioner, registered polysomnographic 34 technologist, or physician employed by or affiliated with the 35 -1- LSB 5212HV (2) 87 ss/rh 1/ 3
H.F. 2290 sleep diagnostic testing facility providing the sleep-related 1 services. 2 Sec. 4. NEW SECTION . 148G.3B Operation of sleep diagnostic 3 testing facilities. 4 A sleep diagnostic testing facility shall comply with all of 5 the following standards: 6 1. A sleep diagnostic testing facility shall be supervised 7 by a physician. 8 2. A sleep diagnostic testing facility shall be accredited 9 by a nationally recognized sleep medicine laboratory or center 10 accrediting agency. 11 3. Data from the provision of sleep-related services shall 12 be interpreted by a physician. 13 4. All sleep-related services shall be conducted by or under 14 the general supervision of a physician or qualified health care 15 professional prescriber. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill concerns the practice of polysomnography in Iowa. 20 The bill adds a requirement that any in-home sleep 21 diagnostic testing be performed with equipment provided by 22 a sleep diagnostic testing facility, hospital, or mobile 23 testing company with a physical location in Iowa and that the 24 patient receive education on the proper use of such equipment 25 by a respiratory care practitioner, respiratory care and 26 polysomnography practitioner, registered polysomnographic 27 technologist, or physician employed by or affiliated with the 28 sleep diagnostic testing facility. The bill also requires 29 that any sleep-related services provided in a patient’s home 30 be performed under the general supervision of a physician or 31 qualified health care professional prescriber and data from the 32 provision of sleep-related services shall be interpreted by a 33 physician. 34 The bill requires a sleep diagnostic testing facility, 35 -2- LSB 5212HV (2) 87 ss/rh 2/ 3
