Section
1.
NEW
SECTION
.
321.200B
Felony
convictions.
1
1.
Upon
receiving
a
person’s
application
for
issuance
or
2
renewal
of
a
driver’s
license,
the
department
shall
conduct
a
3
state
criminal
history
background
check
and
national
criminal
4
history
check
of
the
person
to
determine
whether
the
person
has
5
been
convicted
of
a
felony.
If
the
person
has
been
convicted
6
of
a
felony,
the
department
shall
indicate
that
the
person
7
has
been
convicted
of
a
felony
to
a
peace
officer
or
employee
8
of
a
law
enforcement
agency
at
the
time
the
peace
officer
9
or
employee
of
a
law
enforcement
agency
requests
from
the
10
department
the
person’s
driver’s
license
record
or
operating
11
record
as
part
of
a
traffic
stop
of
a
motor
vehicle
involving
12
the
person.

2.
Notwithstanding
section
321.10,
321.11,
321.11A,
14
or
any
other
provision
of
law
to
the
contrary,
information
15
collected
pursuant
to
this
section
shall
not
be
made
available
16
to
the
public
or
to
any
person
other
than
to
a
peace
officer
17
or
employee
of
a
law
enforcement
agency
requesting
from
the
18
department
a
person’s
driver’s
license
record
or
operating
19
record
as
part
of
a
traffic
stop
of
a
motor
vehicle
involving
20
the
person.

3.
The
department
shall
adopt
rules
as
necessary
for
the
22
administration
of
this
section.

Sec.
2.
APPLICABILITY.
This
Act
applies
to
applications
24
for
issuance
or
renewal
of
a
driver’s
license
received
by
the
25
department
of
transportation
on
or
after
July
1,
2018.

EXPLANATION
27
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
28
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
transportation
(DOT),
30
upon
receiving
a
person’s
application
for
issuance
or
renewal
31
of
a
driver’s
license,
to
conduct
a
state
criminal
history
32
background
check
and
national
criminal
history
check
of
the
33
person
to
determine
whether
the
person
has
been
convicted
of
a
34
felony.
If
the
person
has
been
convicted
of
a
felony,
the
bill

to

the
person

the
person’s
driver’s

the
person.
The
information
6
collected
under
the
bill
is
prohibited
from
being
made
7
available
to
the
public
or
to
any
person
other
than
a
peace
8
officer
or
employee
of
a
law
enforcement
agency
requesting
from
9
the
DOT
a
person’s
driver’s
license
record
or
operating
record
10
as
part
of
a
traffic
stop
of
a
motor
vehicle
involving
the
11
person.
The
bill
requires
the
DOT
to
adopt
rules
as
necessary.

The
bill
applies
to
applications
for
issuance
or
renewal
of
a
13
driver’s
license
received
by
the
DOT
on
or
after
July
1,
2018.
