Section
1.
Section
483A.33,
Code
2018,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
6.
The
director,
any
peace
officer,
an
3
employee
of
the
department,
or
a
member
of
the
immediate
family
4
of
the
director,
peace
officer,
or
employee
shall
not
purchase
5
a
weapon
seized
pursuant
to
section
483A.32
and
disposed
of
6
pursuant
to
this
section
or
section
809.21.
For
purposes
7
of
this
subsection,
“member
of
the
immediate
family”
means
a
8
spouse,
child,
stepchild,
brother,
brother-in-law,
stepbrother,
9
sister,
sister-in-law,
stepsister,
parent,
parent-in-law,
or
10
stepparent
of
the
director,
a
peace
officer,
or
an
employee
of
11
the
department
who
resides
in
the
same
household
in
the
same
12
principal
residence
of
the
director,
a
peace
officer,
or
an
13
employee
of
the
department.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
16
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
the
director,
any
peace
officer,
and
18
any
employee
of
the
department
of
natural
resources
and
any
19
immediate
family
member
of
the
director,
a
peace
officer,
20
or
an
employee
from
purchasing
a
weapon
seized
as
a
public
21
nuisance
incident
to
a
violation
of
specified
statutes
22
and
rules
pertaining
to
wildlife
laws
and
sold
at
a
public
23
sale
or
auction
by
the
department
of
natural
resources
or
24
the
department
of
public
safety.
Legal
weapons,
including
25
rifles
and
shotguns,
seized
in
this
manner
are
disposed
of,
26
as
provided
by
rule,
by
the
department
at
its
annual
public
27
sale.
Other
legal
weapons
seized
may
be
sold
by
the
department
28
of
public
safety
at
public
auction
pursuant
to
Code
section
29
809.21.
