subsection
3,
Code
2018,
is

amended
to
read
as
follows:

a.
(1)
Distribution
of
family
planning
services
program
3
funds
shall
not
be
made
to
any
entity
that
performs
abortions
4
or
that
maintains
or
operates
a
facility
where
abortions
5
are
performed
,
which
shall
not
be
interpreted
to
include
a
6
nonpublic
entity
that
is
a
distinct
location
of
a
nonprofit
7
health
care
delivery
system,
if
the
distinct
location
provides
8
family
planning
services
but
does
not
perform
abortions
9
or
maintain
or
operate
as
a
facility
where
abortions
are
10
performed
.

(2)
The
department
of
human
services
shall
adopt
rules
12
pursuant
to
chapter
17A
to
require
that
as
a
condition
of
13
eligibility
as
a
provider
under
the
family
planning
services
14
program,
each
distinct
location
of
a
nonprofit
health
care
15
delivery
system
shall
enroll
in
the
program
as
a
separate
16
provider,
be
assigned
a
distinct
provider
identification
17
number,
and
complete
an
attestation
that
abortions
are
not
18
performed
at
the
distinct
location.

(3)
For
the
purposes
of
this
section,
“nonprofit
health
20
care
delivery
system”
means
an
Iowa
nonprofit
corporation
21
that
controls,
directly
or
indirectly,
a
regional
health
22
care
network
consisting
of
hospital
facilities
and
various
23
ambulatory
and
clinic
locations
that
provide
a
range
of
24
primary,
secondary,
and
tertiary
inpatient,
outpatient,
and
25
physician
services.
26
b.
For
the
purposes
of
this
section
,
“abortion”
does
not
27
include
any
of
the
following:
28
a.
(1)
The
treatment
of
a
woman
for
a
physical
29
disorder,
physical
injury,
or
physical
illness,
including
a
30
life-endangering
physical
condition
caused
by
or
arising
from
31
the
pregnancy
itself,
that
would,
as
certified
by
a
physician,
32
place
the
woman
in
danger
of
death.

b.
(2)
The
treatment
of
a
woman
for
a
spontaneous
abortion,
34
commonly
known
as
a
miscarriage,
when
not
all
of
the
products

human
conception
are
expelled.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
for
the
participation
of
certain
5
providers
in
the
state
family
planning
services
program.
Under
6
the
state
family
planning
services
program,
distribution
of
7
family
planning
services
program
funds
are
prohibited
from
8
being
made
to
any
entity
that
performs
abortions
or
that
9
maintains
or
operates
a
facility
where
abortions
are
performed.

The
bill
provides
that
any
entity
that
performs
abortions
or
11
that
maintains
or
operates
a
facility
where
abortions
are
12
performed
is
not
to
be
interpreted
to
include
a
nonpublic
13
entity
that
is
a
distinct
location
of
a
nonprofit
health
care
14
delivery
system,
if
the
distinct
location
provides
family
15
planning
services
but
does
not
perform
abortions
or
maintain
16
or
operate
as
a
facility
where
abortions
are
performed.
The
17
bill
directs
the
department
of
human
services
to
adopt
rules
18
pursuant
to
Code
chapter
17A
to
require
that
as
a
condition
of
19
eligibility
as
a
provider
under
the
family
planning
services
20
program,
each
distinct
location
of
a
nonprofit
health
care
21
delivery
system
shall
enroll
in
the
program
as
a
separate
22
provider,
be
assigned
a
distinct
provider
identification
23
number,
and
complete
an
attestation
regarding
non-provision
24
of
abortions
at
the
distinct
location.
The
bill
defines
25
“nonprofit
health
care
delivery
system”
as
an
Iowa
nonprofit
26
corporation
that
controls,
directly
or
indirectly,
a
regional
27
health
care
network
consisting
of
hospital
facilities
and
28
various
ambulatory
and
clinic
locations
that
provide
a
range
29
of
primary,
secondary,
and
