Section
1.
Section
162.10B,
Code
2015,
is
amended
to
read
1
as
follows:

162.10B
Commercial
establishments
——
inspecting
state
3
licensees
and
registrants.
4
1.
The
department
may
inspect
the
commercial
establishment
5
of
a
registrant
or
state
licensee
by
entering
onto
its
6
business
premises
at
any
time
during
normal
working
hours.
The
7
department
may
inspect
records
required
to
be
maintained
by
the
8
state
licensee
or
registrant
as
provided
in
this
chapter
.
If
9
the
owner
or
person
in
charge
of
the
commercial
establishment
10
refuses
admittance,
the
department
may
obtain
an
administrative
11
search
warrant
issued
under
section
808.14
.

2.
a.
Notwithstanding
subsection
1,
a
commercial
breeder
13
who
is
a
state
licensee
may
elect
to
have
an
annual
inspection
14
conducted
by
a
veterinarian
licensed
to
practice
veterinary
15
medicine
under
chapter
169
in
lieu
of
the
department.
In
order
16
to
exercise
this
election,
all
of
the
following
must
apply:
17
(1)
The
department
or
a
veterinarian
acting
under
an
18
existing
election
must
not
have
recorded
an
inspection
19
violation
committed
by
the
commercial
breeder
during
the
prior
20
four
years.
21
(2)
The
commercial
breeder
must
notify
the
department
of
the
22
election
as
required
by
the
department.
23
b.
The
commercial
breeder’s
election
expires
at
the
end
of
24
twelve
months.
25
c.
The
veterinarian
shall
conduct
the
inspection
according
26
to
the
same
requirements
and
shall
have
the
same
access
to
the
27
commercial
breeder’s
premises
as
the
department
would
have
had
28
in
conducting
the
inspection.
The
veterinarian
shall
file
29
an
inspection
report
with
the
department
as
required
by
the
30
department.
The
veterinarian
shall
sign
the
report,
verifying
31
that
the
inspection
complied
with
the
department’s
inspection
32
requirements
and
that
the
veterinarian
had
access
to
the
33
commercial
breeder’s
premises.
The
department
must
receive
the
34
report
within
twenty
days
following
the
date
of
the
inspection.

The
cost
of
an
inspection
conducted
by
a
veterinarian
1
shall
be
paid
by
the
commercial
breeder.

e.
A
commercial
breeder
may
elect
to
have
a
veterinarian
3
conduct
an
inspection
under
this
section
every
other
year.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
6
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
commercial
breeder
of
dogs
or
cats
8
holding
a
state
license
issued
by
the
department
of
agriculture
9
and
land
stewardship
may
elect
to
have
an
annual
inspection
10
conducted
by
a
licensed
veterinarian
in
lieu
of
the
department.
11
In
order
to
exercise
this
election,
the
commercial
breeder
must
12
not
have
committed
an
inspection
violation
during
the
past
four
13
years
and
must
comply
with
notice
requirements
established
14
by
the
department.
The
veterinarian
must
file
an
inspection
15
report
with
the
department.
The
cost
of
the
inspection
is
16
to
be
borne
by
the
commercial
breeder.
The
department
must
17
conduct
an
inspection
every
other
year.
