NEW SECTION . 598.38 Name change for children. 1 A party whose name will be changed pursuant to section 598.37 2 may request, as a part of the decree of dissolution or decree 3 of annulment, a change to the name of the party’s child if 4 the child’s surname is the surname of the other party. If a 5 party makes a request under this section, the court shall order 6 the child’s surname to be changed so that the child’s surname 7 includes the child’s current surname and the surname the party 8 requested under section 598.37. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill relates to a name change for a child whose parents 13 are obtaining a dissolution of marriage. 14 Under current law, a party to a marriage may request, as 15 part of the decree of dissolution or annulment, a change in 16 the person’s name to either the name appearing on the person’s 17 birth certificate or to the name the person had immediately 18 prior to the marriage. 19 The bill provides that if a party makes such a request, the 20 party may also request that the court change the name of the 21 party’s child if the child’s surname is the surname of the 22 other party. If a party makes such a request, the court must 23 order the child’s name to be changed to include the child’s 24 current surname and the surname the party requested for such 25 party’s name change. 26 -1- LSB 5819XS (1) 86 jh/sc 1/ 1
