S.F. 2038 Section 1. Section 279.59, Code 2016, is amended to read as 1 follows: 2 279.59 Access by Professional education associations. 3 1. For purposes of this section, “professional education 4 association” means a not-for-profit association in which the 5 majority of members are practitioners licensed under chapter 6 272. 7 2. The board of directors of a school district shall provide 8 not-for-profit, professional education associations that 9 offer membership to teachers or administrators equal access 10 to teacher or administrator mailboxes for distribution of 11 professional literature. 12 3. Except as otherwise provided under in section 20.9, the 13 board of directors of a school district may deduct from the 14 salary of a teacher or administrator an amount specified by 15 the teacher or administrator for payment of dues or membership 16 fees for the teacher’s or administrator’s membership in a 17 professional education association if the request for the 18 deduction is made in writing during the enrollment period 19 for the professional education association and if the pay 20 period during which the deduction is made, and the frequency 21 and amount of the deduction, are compatible with the school 22 district’s payroll system. The deduction shall continue in 23 effect for not more than one year unless a new written request 24 is filed according to the requirements of this section. The 25 teacher or administrator may terminate the deduction at any 26 time by giving the school district thirty days’ written notice. 27 Moneys deducted under this section shall be paid over promptly 28 to the appropriate professional education association. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 This bill authorizes school districts, upon the request of 33 a teacher or administrator, to pay through payroll deduction 34 the teacher’s or administrator’s dues or membership fees 35 -1- LSB 5532XS (4) 86 kh/ec 1/ 2
S.F. 2038 in any not-for-profit, professional education association. 1 The request must be made in writing during the enrollment 2 period for the professional education association and must be 3 compatible with the school district’s payroll system. The 4 deduction shall continue in effect for not more than one 5 year unless a new written request is filed.
