S.F. 149 Section 1. Section 633.27A, Code 2015, is amended to read 1 as follows: 2 633.27A Docketing guardianship and conservatorship 3 proceedings —— applicability of separate reporting requirements . 4 When a petition is filed for a conservatorship or 5 guardianship, or a combined petition as provided in section 6 633.627 , the administration thereof shall be treated as a 7 separate one proceeding, with a separate one docket number, 8 from the date of the filing of the petition. The separate 9 reporting requirements for conservatorships and guardianships 10 shall continue to apply in a combined petition. The clerk 11 shall clearly indicate on the docket whether the proceedings 12 are voluntary or involuntary and whether a guardianship, a 13 conservatorship, or combined. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 Under current law, the administration of a combined petition 18 for a conservatorship and a guardianship is treated as separate 19 proceedings with separate docket numbers. This bill amends 20 current law so that a combined petition for a conservatorship 21 and a guardianship is treated as one proceeding, with 22 one docket number. The bill also provides that while a 23 combined petition for a conservatorship and a guardianship is 24 administered in the same proceeding, the separate reporting 25 requirements applicable to conservatorships and guardianships 26 each apply. 27 -1- LSB 1136SV (1) 86 jh/nh 1/ 1
