H.J.R. 11 Section 1. The following amendment to the Constitution of 1 the State of Iowa is proposed: 2 Article I of the Constitution of the State of Iowa is amended 3 by adding the following new section: 4 Right to acquire, keep, possess, transport, carry, transfer, 5 and use arms. SEC. 1A. The right of the people to keep and 6 bear arms, as herein expressed, shall not be infringed. 7 The right of an individual to acquire, keep, possess, 8 transport, carry, transfer, and use arms to defend life and 9 liberty and for all other legitimate purposes is fundamental 10 and shall not be infringed upon or denied. Mandatory 11 licensing, registration, or special taxation as a condition 12 of the exercise of this right is prohibited, and any other 13 restriction shall be subject to strict scrutiny. 14 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 15 amendment to the Constitution of the State of Iowa is referred 16 to the general assembly to be chosen at the next general 17 election for members of the general assembly and the secretary 18 of state is directed to cause the same to be published for 19 three consecutive months previous to the date of that election 20 as provided by law. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This joint resolution proposes an amendment to the 25 Constitution of the State of Iowa. 26 The joint resolution expresses that the right of an 27 individual to acquire, keep, possess, transport, carry, 28 transfer, and use arms to defend life and liberty and for all 29 other legitimate purposes is fundamental and shall not be 30 infringed or denied.
