H.F. 75 Section 1. Section 260C.14, Code 2015, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 25. Adopt a policy, to take effect 3 not later than January 1, 2016, relating to an additional 4 classification of students for purposes of determining tuition 5 and fees, that provides equal opportunity for granting resident 6 status to individuals who meet all of the following conditions: 7 a. Attended an accredited school in this state for at least 8 five years as of the date the individual graduated from an 9 accredited high school or received a high school equivalency 10 diploma in this state. 11 b. Is accepted for enrollment by the community college. 12 c. Was not required to pay tuition to attend a public high 13 school in this state. 14 d. Signs an affidavit, if the individual does not have a 15 social security number, stating that the individual will pursue 16 citizenship in the United States at the earliest possible time 17 the individual is able to do so. 18 Sec. 2. Section 262.9, Code 2015, is amended by adding the 19 following new subsection: 20 NEW SUBSECTION . 39. Adopt a policy, to take effect 21 not later than January 1, 2016, relating to an additional 22 classification of students for purposes of determining tuition 23 and fees, that provides equal opportunity for granting resident 24 status to individuals who meet all of the following conditions: 25 a. Attended an accredited school in this state for at least 26 five years as of the date the individual graduated from an 27 accredited high school or received a high school equivalency 28 diploma in this state. 29 b. Is accepted for enrollment by a university under the 30 control of the board. 31 c. Was not required to pay tuition to attend a public high 32 school in this state. 33 d. H.F. 75 citizenship in the United States at the earliest possible time 1 the individual is able to do so. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 This bill directs the board of directors of a community 6 college and the state board of regents to adopt policies 7 that take effect not later than January 1, 2016, relating 8 to an additional classification of students for purposes of 9 determining tuition and fees, that provide equal opportunity 10 for granting resident status to certain individuals. 11 To meet the requirements of the policy, an individual 12 must have attended an accredited school in this state for 13 at least five years or received a high school equivalency 14 diploma in this state, be accepted for enrollment by a public 15 postsecondary institution in this state, must not have been 16 required to pay tuition to attend a public high school in this 17 state, and must sign an affidavit, if the individual does not 18 have a social security number, stating that the individual 19 will pursue U.S. citizenship at the earliest possible time the 20 individual is able to do so. 21 -2- LSB 1240YH (3) 86 kh/nh 2/ 2
