1.
Section
479B.5,
Code
2015,
is
amended
by
adding

the
following
new
subsection:

assessment

the
environmental

estimated
to
result
from
the
construction,
maintenance,

and
operation
of
the
pipeline
or
underground
storage
facility.

The
assessment
shall
be
prepared
or
conducted
by
a
third

party
contracted
with
by
the
applicant
and
identified
by
the

applicant
in
the
petition.

The
board
may
grant
a
permit
in
whole
or
in
part
upon

terms,
conditions,
and
restrictions
as
to
location
and
route
as

it
determines
to
be
just
and
proper.

permit
shall
not
be
granted
to
a
pipeline
company

unless
the
board
determines
that
the
proposed
services
will
16
promote
the
public
convenience
and
necessity
,
and
unless
the
17
environmental
impact
assessment
submitted
pursuant
to
section
18
479B.5,
subsection
10,
estimates
that
the
environmental
impact
19
resulting
from
constructing,
maintaining,
and
operating
the
20
pipeline
or
underground
storage
facility
will
be
minimal
.

3.
Section
479B.10,
Code
2015,
is
amended
to
read
as

follows:

Costs
and
fees.

The
applicant
shall
pay
all
costs
of
the
informational
25
meetings,
environmental
impact
assessment,
hearing,
and
26
necessary
preliminary
investigation
including
the
cost
27
of
publishing
notice
of
hearing,
and
shall
pay
the
actual
28
unrecovered
costs
directly
attributable
to
inspections
29
conducted
by
the
board.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
an
applicant
for
a
permit
for
the

construction,
maintenance,
and
operation
of
a

submit
an

assessment
of
the
resulting
environmental
impact.
The
bill

provides
that
the
assessment
shall
be
prepared
or
conducted
by

a

party
contracted
with

the
applicant

applicant
in
the
petition
for
a
permit.
The
bill

provides
that
a
permit
shall
not
be
granted
by
the
Iowa

utilities
board
unless
the
environmental
impact
is
estimated
to

be
minimal.
The
bill
requires
that
the
applicant
pay
the
costs

associated
with
conducting
the
assessment.
