H.F. 578 Section 1. Section 455B.103, subsection 4, unnumbered 1 paragraph 1, Code 2015, is amended to read as follows: 2 Conduct investigations of complaints received directly 3 or referred by the commission created in section 455A.6 or 4 other investigations deemed necessary. While conducting an 5 investigation, the director may enter at any reasonable time 6 in and upon any private or public property to investigate any 7 actual or possible violation of this chapter , chapter 459 , 8 chapter 459A , chapter 459B , or the rules or standards adopted 9 under this chapter , chapter 459 , chapter 459A , or chapter 459B . 10 However, the owner or person in charge shall be notified. The 11 director shall not prohibit the owner or person in charge from 12 observing an investigation or from taking independent samples 13 or photographs. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 Under this bill, the director of the department of natural 18 resources or the director’s designee shall not prohibit 19 a property owner or person in charge of the property from 20 observing an investigation or from taking independent samples 21 or photographs. 22 -1- LSB 2264HV (3) 86 tr/sc 1/ 1
