H.F. 330 Section 1. SUBSIDIZED GUARDIANSHIP PROGRAM —— 1 ELIGIBILITY. In determining eligibility requirements for 2 financial assistance to guardians under the subsidized 3 guardianship program, the department of human services shall 4 amend its administrative rules to provide the following: 5 1. Any adult person who is the grandparent or other relative 6 of a child and who has been named as a guardian of the child 7 under chapter 232 or 633 may be eligible to receive a subsidy. 8 2. The guardian must provide evidence of financial need in 9 the subsidized guardianship application. 10 3. The child who is the subject of the guardianship may be 11 of any age and need not be part of a sibling group. 12 4. The child who is the subject of the guardianship has been 13 the subject of a child abuse or family assessment report and 14 has been in the custody of the department of human services. 15 Sec. 2. TITLE IV-E GUARDIANSHIP ASSISTANCE STATE PLAN 16 AMENDMENT —— SUBSIDIZED GUARDIANSHIP PROGRAM. The department 17 of human services shall submit a Title IV-E guardianship 18 assistance state plan amendment to the United States department 19 of health and human services to allow Title IV-E funding to be 20 used for a subsidized guardianship program to enable children 21 in the care of grandparents and other relatives to exit state 22 care and be placed in permanent homes. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill requires the department of human services to amend 27 its administrative rules contained in 441 IAC ch. 204 relating 28 to eligibility requirements for guardians under the subsidized 29 guardianship program. The bill provides that any adult person 30 who is the grandparent or other relative of a child who has 31 been named as a guardian of the child under Code chapter 232 32 (juvenile justice) or 633 (probate) may be eligible to receive 33 a subsidy and that a guardian applicant must provide evidence 34 of financial need. H.F. 330 guardianship may be of any age regardless of whether the child 1 is part of a sibling group, and must have been the subject of a 2 child abuse or family assessment report and in the custody of 3 the department of human services. 4 The bill requires the department of human services to 5 submit a Title IV-E guardianship assistance state plan 6 amendment to the United States department of health and human 7 services to allow Title IV-E funding through the federal 8 Fostering Connections to Success and Increasing Adoptions Act 9 of 2008 (Pub. L.
