H.F. 308 Section 1. Section 730.5, subsection 9, paragraph e, Code 1 2015, is amended to read as follows: 2 e. If the written policy provides for alcohol testing, the 3 employer shall establish in the written policy a standard for 4 alcohol concentration which shall be deemed to violate the 5 policy. The standard for alcohol concentration shall not be 6 less than .04 .02 , expressed in terms of grams of alcohol per 7 two hundred ten liters of breath, or its equivalent. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 Current law provides that a private employer may require 12 alcohol testing of employees if the employer maintains a 13 written policy for such testing that is provided to every 14 employee subject to testing, and is available for review by 15 employees and prospective employees. The policy must contain 16 a standard for alcohol concentration which shall be deemed 17 to violate the policy. The standard shall not be less than 18 .04, expressed in terms of grams of alcohol per 210 liters of 19 breath, or its equivalent. 20 This bill lowers the minimum standard permitted to not less 21 than .02, expressed in terms of grams of alcohol per 210 liters 22 of breath, or its equivalent. 23 -1- LSB 1646HV (1) 86 je/nh 1/ 1
