H.F. 2225 Section 1. Section 8.10, Code 2016, is amended by adding the 1 following new subsection: 2 NEW SUBSECTION . 9. Monitor compliance with the state grants 3 equitable distribution requirements established in section 4 8.12. 5 Sec. 2. NEW SECTION . 8.12 State grants —— equitable 6 distribution requirements. 7 1. In addition to the function of developing and 8 administering a system to track, identify, advocate for, and 9 coordinate nonstate grants as provided in section 8.9, the 10 office shall develop and administer a system for monitoring 11 compliance with the state grants equitable distribution 12 requirements specified in subsection 2. 13 2. a. To the extent possible and consistent with the 14 objective, nature, and scope of a particular grant, each 15 state agency, as defined in section 8.11, that administers a 16 nonfederal, discretionary state grant program or fund shall 17 ensure that grants are distributed equitably on the basis 18 of population across the state. An equitable distribution 19 shall be considered to be achieved by distributing grant funds 20 equally per state congressional district over the course of 21 an ongoing three-year period. Grant programs which by their 22 nature are restricted to or focused on a more localized scope 23 of distribution shall be exempt from this requirement. 24 b. The facilitator shall develop a system for obtaining and 25 tracking state agency reporting on an annual basis regarding 26 the extent to which an equitable distribution has been achieved 27 for grant programs to which the equitable distribution 28 requirements are applicable. The facilitator shall submit a 29 report by January 1 annually to the general assembly regarding 30 compliance with the requirements. 31 Sec. 3. STATE GRANTS EQUITABLE DISTRIBUTION STUDY. The 32 office of grants enterprise management established in section 33 8.9 shall conduct a study regarding the extent to which 34 nonfederal, discretionary state grants have been distributed 35 -1- LSB 5865YH (2) 86 rn/rj 1/ 3
H.F. 2225 equitably from the standpoint of population across the state. 1 The study shall analyze the distribution of grant funds for 2 grant programs which by their nature have been or could have 3 been distributed partially or completely statewide over the 4 preceding ten-year period. The office shall complete the study 5 and submit a report to the general assembly by January 1, 2017. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill establishes state grant equitable distribution 10 requirements and requires a state grant equitable distribution 11 study to be conducted. 12 The bill provides that in addition to its functions relating 13 to nonstate grants, the office of enterprise management shall 14 develop and administer a system for monitoring compliance with 15 state grant equitable distribution requirements. 16 The bill provides that to the extent possible and consistent 17 with the objective, nature, and scope of a particular grant, 18 each state agency that administers a nonfederal, discretionary 19 state grant program or fund shall ensure that grants are 20 distributed equitably on the basis of population across the 21 state. An equitable distribution shall be considered to 22 be achieved by distributing grant funds equally per state 23 congressional district over the course of an ongoing three-year 24 period.
