H.F. 2176 Section 1. Section 466B.3, subsection 4, Code 2016, is 1 amended to read as follows: 2 4. Membership —— voting members . The council shall consist 3 of the following voting members: 4 a. The director of the department of natural resources or 5 the director’s designee. 6 b. The director of the division of soil conservation and 7 water quality within the department of agriculture and land 8 stewardship or the director’s designee. 9 c. The director of the department of public health or the 10 director’s designee. 11 d. The director of the department of homeland security and 12 emergency management or the director’s designee. 13 e. The dean of the college of agriculture and life sciences 14 at Iowa state university or the dean’s designee. 15 f. The dean of the college of public health at the 16 university of Iowa or the dean’s designee. 17 g. The dean of the college of natural sciences at the 18 university of northern Iowa or the dean’s designee. 19 h. The director of transportation or the director’s 20 designee. 21 i. The director of the economic development authority or the 22 director’s designee. 23 j. The executive director of the Iowa finance authority or 24 the executive director’s designee. 25 k. The secretary of agriculture, who shall be the 26 chairperson, or the secretary’s designee. As the chairperson, 27 and in order to further the coordination efforts of the 28 council, the secretary may invite representatives from 29 any other public agency, private organization, business, 30 citizen group, or nonprofit entity to give public input at 31 council meetings, provided the entity has an interest in the 32 coordinated management of land resources, soil conservation, 33 flood mitigation, or water quality. H.F. 2176 (1) The director of the Iowa water science center of the 1 United States geological survey or the director’s designee. 2 (2) The state conservationist from the Iowa office of the 3 United States department of agriculture’s natural resources 4 conservation service or the state conservationist’s designee. 5 (3) The executive director for Iowa from the United States 6 department of agriculture’s farm services agency or the 7 executive director’s designee. 8 (4) The state director for Iowa from the United States 9 department of agriculture’s office of rural development or the 10 state director’s designee. 11 (5) The director of region seven of the United States 12 environmental protection agency or the director’s designee. 13 (6) The corps commander from the United States army corps of 14 engineers’ Rock Island district or the commander’s designee. 15 l. The dean of the college of engineering at the university 16 of Iowa or the dean’s designee. 17 Sec. 2. Section 466B.3, Code 2016, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 4A. Membership —— legislative members. The 20 council shall also include four members of the general 21 assembly who shall serve as ex officio, nonvoting members. The 22 legislative members shall be appointed as follows: 23 a. Two members of the senate, one of whom shall be appointed 24 by the majority leader of the senate and one of whom shall be 25 appointed by the minority leader of the senate. 26 b. Two members of the house of representatives, one of whom 27 shall be appointed by the speaker of the house and one of whom 28 shall be appointed by the minority leader of the house. 29 Sec. 3. Section 466B.31, subsections 2 and 4, Code 2016, are 30 amended to read as follows: 31 2. The watershed planning advisory council shall consist of 32 all of the following members: 33 a. One member selected by the Iowa association of 4 business and industry. 5 (4) d. One member selected by the Iowa water pollution 6 control association. 7 (5) e. One member selected by the Iowa rural water 8 association. 9 (6) f. One member selected by growing green communities. 10 (7) g. One member selected by the Iowa environmental 11 council. 12 (8) h. One member selected by the Iowa farm bureau 13 federation. 14 (9) i. One member selected by the Iowa corn growers 15 association. 16 (10) j. One member selected by the Iowa soybean 17 association. 18 (11) k. One member selected by the Iowa pork producers 19 council. 20 (12) l. One member selected by the soil and water 21 conservation districts of Iowa. 22 (13) m. One person representing the department of 23 agriculture and land stewardship selected by the secretary of 24 agriculture. 25 (14) n. One person representing the department of natural 26 resources selected by the director. 27 (15) o. Two members selected by the Iowa conservation 28 alliance. 29 (16) p. One member selected by the Iowa drainage district 30 association. 31 (17) q. One member selected by the agribusiness association 32 of Iowa. 33 (18) r. H.F. 2176 (19) s. One member selected by Iowa rivers revival. 1 b. The nonvoting members of the advisory council shall 2 include all of the following: 3 (1) Two members of the senate. One senator shall be 4 appointed by the majority leader of the senate and one senator 5 shall be appointed by the minority leader of the senate. 6 (2) Two members of the house of representatives. One 7 member shall be appointed by the speaker of the house of 8 representatives and one member shall be appointed by the 9 minority leader of the house of representatives. 10 4. Each year, the voting members of the watershed planning 11 advisory council shall vote to designate one voting member as 12 chairperson. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill adds two members of the senate and two members of 17 the house of representatives to serve as ex officio, nonvoting 18 members on the water resources coordinating council. The 19 purpose of the council is to preserve and protect Iowa’s water 20 resources, and to coordinate the management of those resources 21 in a sustainable and fiscally responsible manner (Code section 22 466B.3). 23 The bill also removes legislative members from the watershed 24 planning advisory council, including two members of the senate 25 and two members of the house of representatives, who all serve 26 as nonvoting members. 27 -4- LSB 5372HH (4) 86 da/nh 4/ 4
