H.F. 217 Section 1. Section 135.63, subsection 4, paragraph a, Code 1 2015, is amended to read as follows: 2 a. The new or changed beds shall not result in an 3 increase in the total number of medical assistance certified 4 intermediate care facility beds for persons with an 5 intellectual disability in the state, exclusive of including 6 those beds at the state resource centers or other state 7 institutions, beyond one thousand six hundred thirty-six beds. 8 Sec. 2. Section 249A.12, Code 2015, is amended by adding the 9 following new subsection: 10 NEW SUBSECTION . 8. Beginning July 1, 2015, the limitation 11 on the number of medical assistance certified intermediate care 12 facility beds for persons with an intellectual disability of 13 one thousand six hundred thirty-six beds specified in section 14 135.63, subsection 4, shall be permanently reduced to reflect 15 any reduction in such beds at the state resource centers due 16 to outplacement and census decline. Any assistance furnished 17 under this chapter to a state resource center attributable 18 to an individual representing such an outplacement or census 19 decline, less an amount which represents the portion of 20 such assistance provided to such individual that reflects 21 the state resource center’s fixed costs and infrastructure, 22 shall continue to be provided to the individual to the extent 23 necessary to instead provide a subsequent placement in a 24 community-based setting. The resource center shall continue to 25 downsize and restructure the resource center’s infrastructure 26 to reflect any permanent decline in beds under this subsection 27 to meet the needs and number of individuals actually served. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill relates to the number of medical assistance 32 certified intermediate care facility beds for persons with an 33 intellectual disability (ICF/ID) in the state. The bill amends 34 the certificate of need provisions relating to ICF/ID beds to 35 -1- LSB 2091YH (5) 86 pf/nh 1/ 2
H.F. 217 provide that the limitation on the number of such beds of 1,636 1 includes such beds at the state resource centers and other 2 state institutions. The bill requires that beginning July 1, 3 2015, the limitation of 1,636 beds shall be permanently reduced 4 to reflect any reduction in such beds at the state resource 5 centers due to outplacement and census decline. Any medical 6 assistance furnished to a state resource center attributable to 7 an individual representing the outplacement or census decline, 8 less an amount for the portion of the medical assistance 9 provided to that individual that reflects the state resource 10 center’s fixed costs and infrastructure, shall continue to 11 be provided to the individual to the extent necessary to 12 instead provide a subsequent placement in a community-based 13 setting.
