H.F. 2151 Section 1. NEW SECTION . 279.54 Public-private partnerships 1 for ancillary services permitted. 2 1. For purposes of this section: 3 a. “Ancillary service” means a support service necessary 4 for the operation of the school that is not directly 5 related to educating students, including but not limited to 6 cafeteria, custodial, facilities maintenance and management, 7 transportation, and technology services. 8 b. “Public-private partnership” means a contract between a 9 school district and a private sector entity including but not 10 limited to a firm, corporation, organization, or association 11 providing for an ancillary service to be performed in whole or 12 in part by the entity for compensation. 13 2. Notwithstanding other provision of law, the board of 14 directors of a school district may enter into a public-private 15 partnership. 16 3. Unless the board determines that extenuating 17 circumstances exist, the board shall ensure that a contract 18 for a public-private partnership provides first priority to 19 existing school employees in hiring decisions involved in 20 implementing the public-private partnership. 21 4. This section shall not be construed to affect the 22 legality of contracts for public-private partnerships entered 23 into before July 1, 2016. 24 Sec. 2. APPLICABILITY. This Act applies to contracts 25 for public-private partnerships entered into on or after the 26 effective date of this Act. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill permits the board of directors of a school district 31 to enter into a public-private partnership. 32 The bill defines “public-private partnership” as a 33 contract between a school district and a private sector 34 entity that provides for an ancillary service to be performed 35 -1- LSB 5639YH (2) 86 je/sc 1/ 2

The 1 bill defines “ancillary service” as a support service 2 necessary for the operation of the school that is not directly 3 related to educating students, including but not limited to 4 cafeteria, custodial, facilities maintenance and management, 5 transportation, and technology services. 6 The bill requires the board to ensure that a contract for a 7 public-private partnership provides first priority to existing 8 school employees in hiring decisions involved in implementing 9 the public-private partnership unless the board determines that 10 extenuating circumstances exist. 11 The bill shall not be construed to affect the legality of 12 contracts for public-private partnerships entered into before 13 July 1, 2016. 14 The bill applies to contracts for public-private 15 partnerships entered into on or after July 1, 2016. 16 -2- LSB 5639YH (2) 86 je/sc 2/ 2
