S.F. _____ Section 1. NEW SECTION . 231D.19 Admission and retention of 1 participants. 2 An adult day services program shall not knowingly admit or 3 retain a participant who meets any of the following criteria: 4 1. Is under the age of eighteen. 5 2. Requires routine three-person assistance with standing, 6 transfer, or evacuation. 7 3. Poses a danger to the participant, other participants, 8 or the adult day services program staff. “Pose a danger” may 9 include but is not limited to the following situations: 10 a. The participant chronically elopes despite intervention. 11 b. The participant is sexually or physically aggressive or 12 abusive. 13 c. The participant’s verbal abuse is unmanageable by staff. 14 d. The participant is in the acute stage of alcoholism, drug 15 addiction, or mental illness. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill establishes criteria that would prohibit the 20 admission or retention of a participant in an adult day 21 services program. The program may not knowingly admit or 22 retain a participant who is under 18 years of age, requires 23 three-person assistance, poses a danger to the participant, to 24 other participants, or to the staff of the adult day services 25 program.
