S.F. 80 Section 1. LEGISLATIVE FINDINGS AND INTENT. The general 1 assembly finds that young people who were brought to this 2 country by their parents and who have been educated in the 3 state’s accredited high schools or received a high school 4 equivalency diploma in this state and who wish to remain in 5 the state to attend college, start businesses, develop new 6 technologies, or work in Iowa’s businesses and industries, are 7 Iowans by choice; it is therefore the intent of the general 8 assembly that these individuals be considered residents of the 9 state for purposes of determining tuition and fees at Iowa’s 10 state postsecondary institutions. 11 Sec. 2. Section 260C.14, Code 2013, is amended by adding the 12 following new subsection: 13 NEW SUBSECTION . 24. Adopt a policy, to take effect 14 not later than January 1, 2014, relating to an additional 15 classification of students for purposes of determining tuition 16 and fees, that provides equal opportunity for granting resident 17 status to individuals who meet all of the following conditions: 18 a. Attended an accredited school in this state for at 19 least five years as of the date the individual graduated from 20 an accredited Iowa high school or received a high school 21 equivalency diploma in this state. 22 b. Is accepted for enrollment by the community college. 23 c. Was not required to pay tuition to attend a public high 24 school in this state. 25 d. Signs an affidavit, if the individual does not have a 26 social security number, stating that the individual will pursue 27 citizenship in the United States at the earliest possible time 28 the individual is able to do so. 29 Sec. 3. Section 262.9, Code 2013, is amended by adding the 30 following new subsection: 31 NEW SUBSECTION . 38. Adopt a policy, to take effect 32 not later than January 1, 2014, relating to an additional 33 classification of students for purposes of determining tuition 34 and fees, that provides equal opportunity for granting resident 35 -1- LSB 1458XS (3) 85 kh/nh 1/ 2
S.F. 80 status to individuals who meet all of the following conditions: 1 a. Attended an accredited school in this state for at 2 least five years as of the date the individual graduated from 3 an accredited Iowa high school or received a high school 4 equivalency diploma in this state. 5 b. Is accepted for enrollment by a university under the 6 control of the board. 7 c. Was not required to pay tuition to attend a public high 8 school in this state. 9 d. Signs an affidavit, if the individual does not have a 10 social security number, stating that the individual will pursue 11 citizenship in the United States at the earliest possible time 12 the individual is able to do so. 13 EXPLANATION 14 This bill provides legislative findings and intent that 15 certain individuals be considered residents for purposes of 16 determining tuition and fees at Iowa’s state postsecondary 17 institutions. The bill directs the board of directors of a 18 community college and the state board of regents to adopt 19 policies that take effect not later than January 1, 2014, 20 relating to an additional classification of students for 21 purposes of determining tuition and fees, which provide 22 equal opportunity for granting resident status to certain 23 individuals. 24 To meet the requirements of the policy, an individual 25 must have attended an accredited school in this state for 26 at least five years or received a high school equivalency 27 diploma in this state, be accepted for enrollment by a public 28 postsecondary institution in this state, must not have been 29 required to pay tuition to attend a public high school in this 30 state, and must sign an affidavit, if the individual does not 31 have a social security number, stating that the individual 32 will pursue U.S. citizenship at the earliest possible time the 33 individual is able to do so. 34 -2- LSB 1458XS (3) 85 kh/nh 2/ 2
