H.F. _____ Section 1. Section 476.1B, subsection 1, paragraph e, Code 1 2014, is amended to read as follows: 2 e. Disconnection of service, as set forth in section 476.20 , 3 other than in connection with deposit and debt collection 4 policies and practices . 5 Sec. 2. Section 476.20, subsection 5, paragraph a, 6 unnumbered paragraph 1, Code 2014, is amended to read as 7 follows: 8 The board shall establish rules which shall be uniform with 9 respect to all public utilities furnishing gas or electricity , 10 other than municipal utilities as provided in section 476.1B, 11 relating to deposits which may be required by the public 12 utility for the initiation or reinstatement of service. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to the regulatory authority of the Iowa 17 utilities board with regard to municipal utility disconnection 18 procedures. 19 Currently, Code section 476.1B provides that a municipally 20 owned utility is not subject to regulation by the Iowa 21 utilities board, subject to certain specified exceptions. One 22 such exception is with regard to disconnection of service, as 23 provided in Code section 476.20. 24 The bill modifies this provision to provide that a 25 municipally owned utility is subject to regulatory action 26 pertaining to disconnection of service, other than in 27 connection with deposit and debt collection policies and 28 practices. The bill makes a corresponding change in Code 29 section 476.20 to specify that the disconnection provisions 30 contained therein do not apply to municipally owned utilities. 31 -1- LSB 5647YC (1) 85 rn/nh 1/ 1
