House Joint Resolution 10 - Introduced HOUSE JOINT RESOLUTION 10 BY MASCHER HOUSE JOINT RESOLUTION A Joint Resolution relating to the placement of a statue in the 1 United States capitol honoring Arabella Mansfield. 2 WHEREAS, each state may provide two statues of notable 3 citizens for display in the United States capitol, and may 4 replace the statues if a resolution to do so is approved by a 5 state’s legislature and governor; and 6 WHEREAS, Arabella Mansfield was born May 23, 1846, on a 7 farm near Burlington, Iowa, graduated from Iowa Wesleyan 8 College in Mount Pleasant; and served as a professor at Simpson 9 College; and 10 WHEREAS, in 1869, Arabella Mansfield became the first woman 11 in the United States admitted to the practice of law; and 12 WHEREAS, Arabella Mansfield continued her career as an 13 educator and was also active in the women’s suffrage movement, 14 chairing the Iowa Women’s Suffrage Convention in 1870, and 15 working with Susan B. Anthony; and 16 WHEREAS, in 1980, Arabella Mansfield was inducted into the 17 Iowa Women’s Hall of Fame, and in 2002 the Iowa Organization 18 of Women Attorneys established the Arabella Mansfield Award to 19 recognize outstanding women lawyers in Iowa; NOW THEREFORE, 20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 21 TLSB 2324YH (2) 85 jr/rj
H.J.R. 10 Section 1. REPLACEMENT AUTHORIZATION. The state of Iowa 1 authorizes the replacement of the statue of Samuel J. Kirkwood 2 with a statue honoring Arabella Mansfield. 3 Sec. 2. COMMITTEE CREATED. A committee of seven is created, 4 to be appointed by the governor and to serve at the pleasure 5 of the governor, to exchange the statue of Samuel J. Kirkwood 6 currently on display in the United States capitol with a statue 7 of Arabella Mansfield. 8 a. The committee shall select its own chairperson and 9 establish its rules of procedure. The committee shall meet as 10 may be deemed necessary by the chairperson. A majority of the 11 members of the committee shall constitute a quorum. 12 b. Members shall serve without compensation or 13 reimbursement for actual expenses. 14 c. The committee shall raise all of the funds necessary for 15 the operation of the committee; and shall solicit donations to 16 exchange the statue, commission the creation of a new statue, 17 transport the replaced statue to the Iowa statehouse, and 18 make all arrangements with the architect of the United States 19 capitol necessary for the new statue to be put into place. 20 Sec. 3. ADMINISTRATIVE SUPPORT. The department of cultural 21 affairs shall provide all necessary administrative support for 22 the committee and shall administer the capitol statuary fund. 23 Sec. 4. CAPITOL STATUARY FUND. A capitol statuary fund 24 is created in the state treasury, to be administered by the 25 department of cultural affairs. The proceeds of the fund 26 shall be used for the purposes specified in section 2 of this 27 resolution. Any funds remaining after the exchange of statues 28 shall be used to suitably restore and relocate the Samuel J. 29 Kirkwood statue. The department may accept gifts, grants, 30 bequests, and other moneys, including but not limited to state 31 or federal moneys, and in-kind contributions for deposit 32 in the fund. Notwithstanding section 12C.7, interest or 33 earnings on moneys in the fund shall be credited to the fund. 34 Notwithstanding section 8.33, any unexpended or unencumbered 35 -1- LSB 2324YH (2) 85 jr/rj 1/ 2
H.J.R. 10 moneys remaining in the fund at the end of a fiscal year shall 1 not revert to the general fund of the state, but shall remain 2 available from the fund for expenditure by the department in 3 succeeding fiscal years for the purposes specified in section 2 4 of this resolution. 5 Sec. 5. DISPLAY OF REPLACED STATUE. The department of 6 administrative services shall provide for a perpetual display 7 of the replaced statue at a suitable location within the 8 statehouse. 9 EXPLANATION 10 Under federal law, each state is allowed to place two statues 11 of its noted personages in the U.S. capitol; and a state may 12 request federal approval for the replacement of a statue. 13 The federal law requires the request to be in the form of a 14 resolution adopted by the general assembly and approved by 15 the governor. The resolution must identify the statue to be 16 replaced, name the individual to be newly commemorated, and 17 cite the individual’s qualifications. The resolution must 18 create a committee to select the sculptor and direct the method 19 of obtaining the necessary funds to meet all expenses. 20 This joint resolution provides for the exchange of the 21 statue of Samuel J. Kirkwood with a statue of Arabella 22 Mansfield. 23 The joint resolution creates a seven-member committee 24 to raise, through donations, all funds necessary to make 25 this exchange. The committee members will not receive any 26 compensation or reimbursement. Staff support is to be provided 27 by the department of cultural affairs. 28 The joint resolution creates a capitol statuary fund in the 29 state treasury, administered by the department of cultural 30 affairs.
